WHEREAS the St. Regis band of Indians situated at the village of St. Regis, in the township of Dundee, county of Huntingdon, in the province of Quebec, hold certain islands in the river St. Lawrence, between the town of Prescott and the village of Lancaster, as part of their Reserve; and whereas over a century ago the chiefs and headmen of the said band purported to grant leases of a number of the said islands, or portions of islands, in consideration of a nominal rental, for terms of ninety-nine years with covenants for renewals of the said leases for further periods of ninety-nine years; and whereas in the interest of the Indians of the said band, the Crown has taken action in the courts to have these alleged leases declared null and void and has already succeeded in recovering what are known as Lewis island, Snyder island and Thompson or Macmaster island; and whereas actions are still pending in respect of Thomas or Hamilton island, and what is known as the Easterbrook farm on Cornwall island; and whereas it is considered that the revenues to be derived from these islands maintained in their scenic beauty and leased for summer resorts or agricultural purposes, would be of much greater benefit to the band than they would derive from having these islands thrown open to the Indians generally resulting in the groves of timber being cut down and removed for firewood, as has happened with many other islands, rendering them non-productive as summer resorts: Therefore His Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:—
CONSIDÉRANT que la bande d’Indiens de St-Régis, située au village de St-Régis, dans le canton de Dundee, comté d’Huntingdon, dans la province de Québec, détient, comme partie de sa réserve, certaines îles situées dans le fleuve Saint-Laurent, entre la ville de Prescott et le village de Lancaster; et considérant qu’il y a plus d’un siècle les chefs et principaux membres de ladite bande ont entrepris de consentir des baux pour un nombre desdites îles, ou parties d’îles, en considération d’un loyer nominal, pour des périodes de quatre-vingt-dix-neuf ans avec stipulations de renouvellement desdits baux pour d’autres périodes de quatre-vingt-dix-neuf ans; et considérant que, dans l’intérêt des Indiens de ladite bande, la Couronne s’est adressée aux tribunaux pour faire déclarer nuls et de nul effet les prétendus baux et qu’elle a déjà réussi à recouvrer les îles connues sous le nom de Lewis, Snyder et Thompson ou île Macmaster; et considérant que les procédures sont encore en suspens au sujet de l’île Thomas ou Hamilton, et de ce qui est connu comme étant la ferme Easterbrook, sur l’île de Cornwall; et considérant que les revenus à retirer en entretenant la beauté scénique de ces îles et en les louant comme villégiatures ou pour des fins agricoles, seraient bien plus profitables à la bande que ceux qu’elle pourrait retirer en permettant aux Indiens d’occuper ces îles, ce qui aurait pour résultat général la coupe et l’enlèvement du bois des bosquets pour en faire du bois de chauffage comme la chose s’est produite dans maintes autres îles et les a rendues inutilisables comme villégiatures : À ces causes, Sa Majesté, sur l’avis et du consentement du Sénat et de la Chambre des Communes du Canada, décrète :

COMMENCING at the intersection of the western bank of Granite Brook and the southern side of the bridge of Highway 103; THENCE, in a straight southeasterly line to the northernmost point of an island known as Timber Island at latitude 43°50′45″ and longitude 64°57′45″; THENCE, in a straight northeasterly line to a point at the high tide water mark on the east side of Port Hebert Inlet at latitude 43°51′10″ and longitude 64°56′45″; THENCE, northwesterly and southwesterly following the high tide water mark to the point of commencement; together with all waters overlying the said parcel and all islands, shoals or rocks contained therein.
