Mr. Ted McWhinney: Mr. Speaker, the point I have been making is that with the progressive development of international law under the United Nations charter, it is a step in international law, initially sponsored by Judge Lachs and that very interesting dissenting opinion in 1968, that non-signatories to an international treaty can be legally bound by the treaty either, to use an analogy, because the treaty becomes, by virtue of the number of states signing it, part of customary international law, or because the sheer number indicates it is part of the general principles of law recognized by nations under article 38(1)(d) of the World Court statute.

Irwin Cotler: With regard to international treaties and conventions dealing in whole or in part with human rights and with Canada’s international obligations in this regard: (a) does the government have any formal or informal procedures for regular review of those international human rights treaties that Canada has not yet signed, ratified, or otherwise accepted; (b) does the government have any formal or informal guidelines according to which it determines whether the specific obligations contained in a treaty or other international undertaking conflicts with the Constitution Act, 1867, and if so where can these guidelines be accessed; (c) do the guidelines referred to in (b) specify the standard according to which the government determines if any obligation contained in a treaty or other international undertaking violates any section of the Constitution Act, 1867; (d) has the government engaged in any review of its obligations under the Convention on the Elimination of Racial Discrimination (CERD); (e) does the government have any formal or informal guidelines according to which it determines whether the specific obligations contained in a treaty or other international undertaking require implementing legislation in order for Canada to be able to ratify or otherwise accept it, and if so where can these guidelines be accessed; (f) does the government have a position as to whether international agreements that establish a complaints mechanism or communications procedure for enforcement of the rights and obligations contained therein are necessarily unconstitutional; (g) does the government have a policy as to whether Canada will accept such agreements referred to in (f); (h) does the government undergo review of proposed international human rights agreements that would establish such a mechanism or procedure referred to in (f) on a case by case basis, (i) who is involved in this review, (ii) are the provinces and other inte ...

The Bloc Québécois will therefore start bringing forward again proposals to restore democracy in the making of international treaties, including the obligation on the government to submit to the House any international treaty or agreement it enters into, before it is ratified; the obligation on the government to publish every international agreement it is involved in; approval and vote in the House on any major treaty, following consideration by a special committee on international agreements, before the government can ratify it; respect for the jurisdictions of Quebec and the provinces at every stage of the treaty-making process: negotiations, signing, and ratification.

The Bloc Québécois will raise this issue again and will bring forward proposals to restore democracy in the conclusion of international treaties. Such proposals will include requiring the government to present to the House all international treaties and agreements it has signed before ratifying them, requiring the government to publish all international agreements by which it is bound, requiring the vote and approval of the House following an analysis by a special committee tasked with examining international agreements and major treaties before the government may ratify them, and calling on the government to respect Quebec and provincial jurisdictions in the entire process of concluding treaties, that is, all stages of negotiation, signing and ratification.

Again, it would be very desirable for the House of Commons and its parliamentary committees to review international treaties and proposed treaties during negotiations, so that in future members of parliament can have some influence on negotiators, on the content of these treaties and proposed treaties, before Canada makes a commitment or expresses, through its signature, its intention to comply in good faith with the international treaties that it ratifies.
J'aimerais rappeler à cette Chambre qu'il serait tout à fait souhaitable que la Chambre des communes et ses comités parlementaires soient saisis de traités internationaux et de projets de traités pendant le cours des négociations, de façon à ce que les députés aient une influence sur les négociateurs, sur le contenu de ces projets et de ces traités avant que le Canada ne s'engage ou n'exprime, par sa signature, la volonté d'exécuter de bonne foi les traités internationaux qu'il ratifiera ultérieurement.
