According to the Court of Justice's established case-law, the Commission is competent to decide that the State concerned must abolish or alter aid (58) when it has found that it is incompatible with the common market, The Court has also consistently held that the obligation on a State to abolish aid regarded by the Commission as being incompatible with the common market is designed to re-establish the previously existing situation (59).

For the reasons outlined above, considered individually or together, the Commission issued a decision on 9 December 2004, which declared the proposed concentration incompatible with the common market pursuant to Article 8(3) of the ECMR in that it strengthens dominant positions in several gas and electricity markets in Portugal as a result of which effective competition would be significantly impeded in a substantial part of the common market.

With a view to preserving the guidance that may be drawn from past judgments of the European courts and Commission decisions pursuant to Regulation (EEC) No 4064/89, while at the same time maintaining consistency with the standards of competitive harm which have been applied by the Commission and the Community courts regarding the compatibility of a concentration with the common market, this Regulation should accordingly establish the principle that a concentration with a Community dimension which would significantly impede effective competition, in the common market or in a substantial part thereof, in particular as a result of the creation or strengthening of a dominant position, is to be declared incompatible with the common market.
Afin de préserver les enseignements pouvant être tirés des précédents arrêts prononcés par les juridictions européennes et des décisions prises par la Commission en vertu du règlement (CE) n° 4064/89, tout en sauvegardant en même temps la cohérence avec les critères de détermination du préjudice concurrentiel appliqués par la Commission et les juridictions communautaires pour statuer sur la compatibilité d'une concentration avec le marché commun, le présent règlement devrait en conséquence établir le principe selon lequel les concentrations de dimension communautaire qui entraveraient de manière significative une concurrence effective, notamment du fait de la création ou du renforcement d'une position dominante, dans le marché commun ou une partie substantielle de celui-ci doivent être déclarées incompatibles avec le marché commun.

(33) The Commission should have the task of taking all the decisions necessary to establish whether or not concentrations with a Community dimension are compatible with the common market, as well as decisions designed to restore the situation prevailing prior to the implementation of a concentration which has been declared incompatible with the common market.
(33) La Commission devrait être chargée de prendre toutes les décisions visant à établir si les concentrations de dimension communautaire sont compatibles ou non avec le marché commun, ainsi que les décisions visant à rétablir la situation antérieure à la réalisation d'une concentration déclarée incompatible avec le marché commun.

Accordingly, Regulation (EEC) No 4064/89 established the principle that a concentration with a Community dimension which creates or strengthens a dominant position as a result of which effective competition in the common market or in a substantial part of it would be significantly impeded should be declared incompatible with the common market.

Therefore, in the interests of legal certainty, it should be made clear that this Regulation permits effective control of all such concentrations by providing that any concentration which would significantly impede effective competition, in the common market or in a substantial part of it, should be declared incompatible with the common market.

(103) The observations submitted by the Italian authorities in support of their request that the Commission should refrain from ordering recovery of the aid if it were found to be incompatible with the common market are not sufficient to justify disregarding the obligation imposed by Regulation (EC) No 659/1999, deriving from the fact that the aid in question is incompatible with the common market and was granted unlawfully, for the following reasons:

State aid which is granted without imposing any obligation serving the objectives of the Common Fisheries Policy on the part of recipients and which is intended to improve the situation of undertakings and increase their business liquidity or is calculated on the quantity produced or marketed, product prices, units produced or the means of production, and which has the effect of reducing the recipient's production costs or improving the recipient's income is, as operating aid, incompatible with the common market.

Whereas the effectiveness of all the measures governing the common organisation of the market in hops would be prejudiced by the granting of certain aids on the part of the Member States ; whereas the provisions of the Treaty enabling aids granted by the Member States to be evaluated and aids which are incompatible with the common market to be prohibited should be applied to the market in hops ; whereas, however, provision should be made for a temporary system for national aid granted for contracts lasting several years made before the entry into force of the common organisation of the market;
