Algeria argues, however, that as a foreign State it enjoys immunity from jurisdiction in Germany, recognised by international law under which a State cannot be subjected to the jurisdiction of another State.

Firmly believes that the ICC States Parties and Signatory States are obliged under international law not to defeat the object and purpose of the Rome Statute, under which, according to its Preamble, "the most serious crimes of concern to the international community as a whole must not go unpunished" and that States Parties are obliged to cooperate fully with the Court, in accordance with Article 86 of the Rome Statute, thus preventing them from entering into immunity agreements which remove certain citizens from the States" or the International Criminal Court's jurisdictions, undermining the full effectiveness of the ICC and jeopardising its role as a complementary jurisdiction to the State jurisdictions and a building block in collective global security;
3. croit fermement que les États parties à la CPI et les États signataires ont, selon le droit international, l'obligation de ne pas contrarier l'objectif du statut de Rome selon lequel, conformément au préambule dudit statut, "les crimes les plus graves qui préoccupent la communauté internationale dans son ensemble ne doivent pas rester impunis" et que les États parties doivent coopérer pleinement avec la Cour en vertu de l'article 86 du statut de Rome, les empêchant ainsi de souscrire des accords d'immunité qui permettent à certains citoyens d'échapper à la juridiction des États ou de la Cour pénale internationale, de porter atteinte à l'efficacité de la CPI et de nuire à son rôle de juridiction complétant la juridiction des États et de pièce maîtresse de la sécurité collective globale;
