E. whereas the Deputy Minister of Justice of the Republic of Azerbaijan, Vilayat Zahirov, sent an official letter to the Ministry of Public Administration and Justice of Hungary on 15 August 2012, in which he stated that the execution of the decisions of foreign states’ courts regarding the transfer of sentenced persons to serve the remaining part of their prison sentences in the Republic of Azerbaijan were carried out in accordance with Article 9(1)(a) of the convention, without any conversion of their sentences; whereas he further gave an assurance that, according to the Criminal Code of the Republic of Azerbaijan, the punishment of a convict serving a life sentence could only be replaced by a court with a term of imprisonment for a specified period, and that the convict could be released on conditional parole only after serving at least 25 years of his or her prison sentence; and whereas the Azerbaijani authorities subsequently denied having given any diplomatic assurances to the Hungarian authorities;

As is the case in the Convention between the Member States of the European Communities on the enforcement of foreign criminal sentences of 13 November 1991, the State of enforcement has two options as to the manner of enforcement: the relevant authorities of the State of enforcement must either proceed to immediate enforcement of the sentence or convert the sentence, through a judicial or administrative procedure, into a decision of that State, thereby substituting for the penalty imposed in the sentencing State a penalty prescribed by the law of the administering State for the same offence (Article 9).

The chief purpose of the Convention is to promote the social rehabilitation of persons sentenced to custodial sentences or measures by allowing foreigners who are deprived of their liberty as a result of their commission of a criminal offence to be given the opportunity to serve their sentences within their own original communities.

[20] This is why both the 1970 The Hague Convention on the International Validity of Criminal Judgements and the 1991 Convention on the Enforcement of Foreign Criminal Sentences limit the possibility to enforce a sentence in another country to cases where the person is a national of, or resides within, or is already serving a sentence in that other country.

5. If the offence for which the new proceedings being conducted was committed before the previous conviction had been handed down or fully executed, paragraphs 1 and 2 shall not have the effect of requiring Member States to apply their national rules on imposing sentences, where the application of those rules to foreign convictions would limit the judge in imposing a sentence in the new proceedings.
