We must take the UN concept of human rights as our basis, and this comprises three central categories: firstly, what might be termed the negative rights to freedom, i.e. the right of each person to enjoy freedom from unjustified state coercion and other violence. Secondly, the positive rights: these guarantee the participation of the individual in political and social decision-making processes. And thirdly, social rights and the right to development which are invoked particularly by third world countries: they insist that civil and political rights also include the conditions that are necessary in order to exercise these rights.
Nous devons nous fonder sur la notion des droits de l'homme telle que la conçoivent les Nations unies et qui comprend trois grandes catégories de normes: en premier lieu, les "libertés négatives", c'est-à-dire celles qui garantissent à chacun le droit de ne pas être victime d'une contrainte - ou d'une autre violence - injustifiée de la part de l'État; ensuite, les droits positifs, qui garantissent la participation de chacun au processus de décision dans le domaine politique et social; enfin, les droits de participation sociale et le droit au développement - auxquels se réfèrent plus particulièrement les pays du tiers monde - sur la base desquels il faut également compter au nombre des droits civils et politiques les conditions permettant de les exercer.
