Where the federal government or a federal authority enters into an agreement with a government or other entity to provide financial assistance under section 5(1)(b) in relation to projects that are to be carried out both outside Canada and outside federal lands, and the essential details of such projects are not specified, current section 54(2) requires the federal government or federal authority to ensure, where practicable and subject to other applicable agreements, that the agreement or arrangement provides for an environmental assessment of such projects, as early as practicable in the planning stages, before irrevocable decisions are made, and in accordance with either the Act or regulations, or with an environmental assessment process that is in effect in the foreign state in which the projects are to be carried out and that is consistent with the requirements of the Act.

We recommend that the Government of Canada engage First Nations in a process of consultation, justification and accommodation in accord with the doctrine established by the Supreme Court of Canada in R. v. Sparrow, and subsequent decisions, in respect of any act or decision that has impacted or infringed or may impact upon or infringe the rights of First Nations recognized and affirmed under section 25 and section 35 of the Constitution Act, 1982; and that the scope of the process of consultation, justification and accommodation include: all legislation and regulations enacted by Parliament or enacted by the provincial legislatures in the absence of clear federal powers since at least 1982 that continue to impact upon or infringe the authority of First Nation governments and the rights of First Nation citizens, including legislation defining the status of First Nation citizens or affecting First Nation authority over the protection and care of First Nation children and families; and all federal authorizations, allocations and designations issued prior to 1982 that have continued to impact upon or infringe the rights of First Nations since 1982, including those federal authorizations, allocations or designations related to natural resource developments such as hydroelectric projects, mining projects and forestry projects.

50(b)(i) (2) The portion of the definition " federal authority" in subsection 2(1) of the Act after paragraph (a) is replaced by the following: (b) an agency of the Government of Canada, a parent Crown corporation, as defined in subsection 83(1) of the Financial Administration Act, or any other body established by or pursuant to an Act of Parliament that is ultimately accountable through a Minister of the Crown in right of Canada to Parliament for the conduct of its affairs, (c) any department or departmental corporation set out in Schedule I or II to the Financial Administration Act, and (d) any other body that is prescribed pursuant to regulations made under paragraph 59(e), but does not include the Commissioner in Council or an agency or body of the Yukon Territory, the Northwest Territories or Nunavut, a council of the band within the meaning of the Indian Act, Export Development Canada, the Canada Pension Plan Investment Board, a Crown corporation that is a wholly-owned subsidiary, as defined in subsection 83(1) of the Financial Administration Act, The Hamilton" (b) adding after line 3 on page 2 the following: " (2.1) Subsection (2) comes into force on the day that is three years after the day on which this Act receives royal assent" .
