In duly justified situations, the Supervisory Committee may ask the Office for additional information on investigations, including reports and recommendations on closed investigations, without however interfering with the conduct of investigations in progress.

(4) Whereas the Scientific Steering Committee adopted an opinion on safety of gleatine on 26 and 27 March 1998 which was updated on 18 and 19 February 1999; whereas this opinion addresses the questions under which conditions of sourcing of the material and/or of type of material used and/or production process gelatine destined for human consumption can be considered free of bovine spongiform encephalapathy (BSE) infectivity; whereas in this opinion, the Scientific Steering Committee distinguishes the recommended measures between different categories of geographical risk; whereas a final implementation can only follow after classification of countries and regions; whereas on 21 May 1999, at the general session of the International Office of Epizootics (IOE) Committee, a proposal of the IOE International Animal health Code Commission concerning the criteria for the determination of the BSE status of a country or zone was adopted; whereas in accordance to the procedure laid down in Commission Recommendation 98/477/EC(6), concerning information necessary to support applications for the evaluation of the epidemiological status of countries with respect to transmissible spongiform encephalopathies, certain Member States and third countries submitted data necessary to allow assessment of their geographical risk; whereas, considering recent development of the IOE Code on BSE, pending the above scientific assessment and the subsequent decision making, the entry into force of rules for the production of gelatine derived from ruminant bones should be suspended until Community legislation concerning classification of countries or regions as regards their BSE status is applicable; whereas the Commission will initiate the procedure for the entry into force of rules for the production of gelatine derived from ruminant bones without delay after the adoption of Community legislation concerning classification of countries or regions as regards their BSE status;
(4) considérant que le comité scientifique directeur a adopté un avis sur la sécurité de la gélatine les 26 et 27 mars 1998, qui a été mis à jour les 18 et 19 février 1999; que cet avis traite de la question de savoir dans quelles conditions d'approvisionnement en matières et/ou en types de matières utilisés et/ou de procédés de fabrication la gélatine destinée à la consommation humaine peut être considérée comme indemne d'infection par l'encéphalopathie spongiforme bovine (ESB); que, dans son avis, le comité scientifique directeur répartit les mesures recommandées entre différentes catégories de risque géographique; que la mise en oeuvre finale ne peut avoir lieu qu'une fois établie la classification des pays et des régions; que, lors de la session générale du comité de l'Office international des épizooties (OIE), le 21 mai 1999, une proposition de la commission du Code zoosanitaire animal international de l'OIE concernant les critères de détermination du statut d'un pays ou d'une zone au regard de l'ESB a été adoptée; que, conformément à la procédure prévue par la recommandation 98/477/CE de la Commission du 22 juillet 1998 concernant les informations requises à l'appui des demandes d'évaluation du statut épidémiologique des pays au regard des encéphalopathies spongiformes transmissibles(6), certains États membres et pays tiers ont présenté les données requises pour pouvoir évaluer leur risque géographique; que, compte tenu de l'évolution récente du code de l'OIE sur l'ESB, et en attendant l'évaluation scientifique précitée ainsi que les décisions qui en découleront, l'entrée en vigueur des règles de fabrication de la gélatine issue d'os de ruminants doit être suspendue jusqu'à ce que la législation communautaire relative à la classification des pays ou régions en matière de statut ESB soit applicable; que la Commission engagera sans retard la procédure destinée à l'entrée en vigueur des règles de fabrication de la gélatine issue d'os de ruminants après l'a ...
