The position of the European Community in the ECAA Joint Committee set up by Article 18 of the Multilateral Agreement between the European Community and its Member States, Albania, Bosnia and Herzegovina, Bulgaria, Croatia, the former Yugoslav Republic of Macedonia, Iceland, Montenegro, Norway, Romania, Serbia and the United Nations Interim Administration Mission in Kosovo on the establishment of a European Common Aviation Area, with regard to the amendment of Annex I to the Agreement, shall be based on the Annex to this Decision.

On 13 July the latter committee decided that the Joint Committee set up under the Agreement between the Community, Iceland and Norway and entrusted with particular powers and responsibilities in relation to the Protocol may be regarded as a 'specific institutional framework' within the meaning of the second subparagraph of Article 300(3) of the EC Treaty.

(3) Participation in the Community mechanism is open to Member States, but should also be open to Norway, Iceland and Liechtenstein in the light of Decision of the EEA Joint Committee No 135/2002 of 27 September 2002 amending Protocol 31 to the EEA Agreement on cooperation in specific fields outside the four freedoms(3).

At the same time the Joint Committee set up by Article 3 of the Agreement of 19 January 2001 between the European Community and the Republic of Iceland and the Kingdom of Norway concerning the criteria and mechanisms for establishing the State responsible for examining a request for asylum lodged in a Member State or Iceland or Norway met twice in the second half of 2002 so that these two countries, now associated with the Schengen acquis and the Dublin Convention, could make their views known on the proposal.
Parallèlement, le comité mixte institué par l'article 3 de l'accord du 19 janvier 2001 entre la Communauté européenne, la République d'Islande et le Royaume de Norvège relatif aux critères et aux mécanismes permettant de déterminer l'État responsable de l'examen d'une demande d'asile introduite dans un État membre, en Islande ou en Norvège, s'est réuni deux fois au cours du deuxième semestre 2002 afin que ces deux États associés au dispositif Schengen et à la convention de Dublin puissent faire connaître leurs observations sur la proposition.

However, Norway, Iceland and Liechtenstein have also become involved since the entry into force (on 1 August 2000) of EEA Joint Committee Decision No 36/2000, amending Protocol 31 to the EEA Agreement, on co-operation in specific fields outside the four freedoms..
