3. Three measures have already been adopted: a Directive 2010/64/EU of the European Parliament and of the Council on the right to interpretation and translation in criminal proceedings[2] in October 2010 and Directive 2012/13/EU of the European Parliament and of the Council on the right to information in criminal proceedings in May 2012[3], and Directive 2013/48/EU of the European Parliament and of the Council on the right of access to a lawyer in criminal proceedings and in European arrest warrant proceedings, and on the right to have a third party informed upon deprivation of liberty and to communicate with third persons and with consular authorities while deprived of liberty in October 2013.[4] Measures on the protection of vulnerable persons suspected or accused in criminal proceedings are presented as a package with the present initiative, together with a Directive on the strengthening of certain aspects of the presumption of innocence and of the right to be present at trial in criminal proceedings, which form part of the underlying principles of the right of fair trial.

Trois mesures ont déjà été adoptées: en octobre 2010, la directive 2010/64/UE du Parlement européen et du Conseil relative au droit à l’interprétation et à la traduction dans le cadre des procédures pénales[2]; en mai 2012, la directive 2012/13/UE du Parlement européen et du Conseil relative au droit à l’information dans le cadre des procédures pénales[3] et, en octobre 2013, la directive 2013/48/UE du Parlement européen et du Conseil relative au droit d’accès à un avocat dans le cadre des procédures pénales et des procédures relatives au mandat d’arrêt européen, au droit d'informer un tiers dès la privation de liberté et au droit des personnes privées de liberté de communiquer avec des tiers et avec les autorités consulaires[4]. Des mesures relatives à la protection des personnes vulnérables soupçonnées ou poursuivies dans le cadre de procédures pénales sont présentées sous la forme d'un paquet législatif, comprenant la présente initiative, ainsi qu’une directive portant renforcement de certains aspects de la présomption d’innocence et du droit d’assister à son procès dans le cadre des procédures pénales, qui font partie des principes fondamentaux qui sous-tendent le droit à un procès équitable.

When, at the time a person becomes a suspect or accused person in criminal proceedings, that person has reached the age of 18, but the criminal offence was committed when the person was a child, Member States are encouraged to apply the procedural safeguards provided for by this Directive until that person reaches the age of 21, at least as regards criminal offences that are committed by the same suspect or accused person and that are jointly investigated and prosecuted as they are inextricably linked to criminal proceedings which were initiated against that person before the age of 18.

other parties to a criminal offence, such as persons who might be called on to testify in investigations in connection with criminal offences or subsequent criminal proceedings, persons who can provide information on criminal offences, or contacts or associates of one of the persons referred to in points (a) and (b).

For the prevention, investigation and prosecution of criminal offences, it is necessary for competent authorities to process personal data collected in the context of the prevention, investigation, detection or prosecution of specific criminal offences beyond that context in order to develop an understanding of criminal activities and to make links between different criminal offences detected.
Aux fins de la prévention des infractions pénales, et des enquêtes et poursuites en la matière, les autorités compétentes ont besoin de traiter des données à caractère personnel, collectées dans le cadre de la prévention et de la détection d'infractions pénales spécifiques, et des enquêtes et poursuites en la matière au-delà de ce cadre, pour acquérir une meilleure compréhension des activités criminelles et établir des liens entre les différentes infractions pénales mises au jour.

This Directive applies to protection measures which aim specifically to protect a person against a criminal act of another person which may, in any way, endanger that person’s life or physical, psychological and sexual integrity, for example by preventing any form of harassment, as well as that person’s dignity or personal liberty, for example by preventing abductions, stalking and other forms of indirect coercion, and which aim to prevent new criminal acts or to reduce the consequences of previous criminal acts.
La présente directive est applicable aux mesures de protection qui visent spécifiquement à protéger une personne contre une infraction commise par une autre personne, susceptible de mettre en danger, de quelque manière que ce soit, sa vie ou son intégrité physique, psychologique ou sexuelle, en prévenant par exemple toute forme de harcèlement, ainsi que sa dignité ou sa liberté personnelle, en prévenant par exemple les enlèvements, la traque et d’autres formes de contrainte indirecte, et qui visent à empêcher que de nouvelles infractions ne soient commises ou à atténuer les conséquences des infractions antérieures.
