4. The Agency shall make the forced-return monitors available upon request to participating Member States to monitor, on their behalf, the correct implementation of the return operation and return interventions throughout their duration.

Provisions not correctly transposed by Spain include the definition of return in national law, the obligation to issue return decisions to irregularly staying third country nationals and a clear definition of the role of the Ombudsman in his function as a monitoring body in accordance with the Return Directive.

7. If a Member State has constituted an interest-bearing deposit or has paid an annual fine for a given calendar year and the Council thereafter concludes, in accordance with Article 10(1) of Regulation (EU) No 1176/2011 that the Member State has taken the recommended corrective action in the course of that year, the deposit paid for that year together with the accrued interest or the fine paid for that year shall be returned to the Member State pro rata temporis.
7. Si un État membre a constitué un dépôt portant intérêt ou s’est acquitté d’une amende annuelle au titre d’une année civile donnée et que le Conseil conclut ultérieurement, conformément à l’article 10, paragraphe 1, du règlement (UE) no 1176/2011, que l’État membre a pris au cours de ladite année les mesures correctives recommandées, le dépôt constitué au titre de cette année-là majoré des intérêts acquis ou l’amende payée au titre de cette année-là lui sont restitués pro rata temporis.
