(91a) In order to ensure the necessary input and better involvement of Member States when the Commission exercises its implementing powers with a regard to this Regulation in certain particularly sensitive policy areas relating to the ESI Funds and in order to strengthen the Member States' role in adopting uniform conditions in such areas or other executive measures with substantial implications or with a potentially significant impact on either the national economy, the national budget or on the proper functioning of the public administration of the Member States, the implementing acts relating to the methodology for providing information on the support for climate change objectives, the arrangements to ensure a consistent approach for determining in the performance framework the milestones and targets for each priority and for assessing the attainment of the milestones and targets, the nomenclature, based on which the categories of intervention are to be defined concerning the priority axis in operational programmes, the technical characteristics of information and communication measures for the operation and instructions for creating the emblem and the definition of its standard colours, the model to be used when submitting the financial data to the Commission for monitoring purposes as well as the models for payment applications and for the accounts, the format for notification of the refusal by the Commission of any financial contribution to a major project, the terms and conditions of the electronic data exchange to be established for official exchanges of information between the Member States and the Commission, including the information concerning Member States' responsibilities, the model for the report and the opinion of the independent audit body in connection with the designation procedures of the managing authorities and, where appropriate, of the certifying authorities, the technical specifications of the management and control system, the detailed arr ...
(91) Afin de garantir des conditions uniformes pour l'application du présent règlement, il convient que les compétences d'exécution relatives aux conditions standard pour le contrôle des instruments financiers, aux modèles pour la communication sur les instruments financiers, au système d'échange de données par voie électronique entre l'État membre et la Commission, au modèle de programme opérationnel pour les Fonds, à la nomenclature pour les catégories d'intervention, à la forme des informations sur les grands projets , au modèle du plan d'action commun, aux modèles des rapports annuel et final de mise en œuvre, à certaines caractéristiques techniques des mesures d'information et de publicité et aux instructions y relatives, aux règles sur l'échange d'informations entre bénéficiaires et autorités de gestion, autorités de certification, autorités d'audit et organismes intermédiaires, au modèle de rapport et d'avis de l'organisme d'audit indépendant et au modèle de description du système de gestion et de contrôle, au modèle des comptes, au modèle de la déclaration d'assurance de gestion, aux modèles de la stratégie d'audit, de l'avis et du rapport annuel de contrôle et à la méthodologie applicable à la méthode d'échantillonnage, et au modèle pour les demandes de paiement, soient exercées conformément au règlement (UE) n° 182/2011 du Parlement européen et du Conseil du 16 février 2011 .

A judgment or decision granting conditional release that contains one or more of the following suspensory measures, obligations or instructions may be transferred to another Member State, in which the sentenced person is lawfully and ordinarily resident, for the purpose of recognition and supervision of those measures or obligations or instructions.

If the sentenced person leaves the executing State or ceases to have a lawful and ordinary residence in the executing State , the competent judicial authority of the executing State shall transfer jurisdiction in respect of the supervision of the suspensory measures and the obligations or instructions which constitute alternative sanctions and in respect of all further decisions relating to the execution of the judgment (or if appropriate the decision granting conditional release) to the competent judicial authority of the issuing State.
Si la personne condamnée quitte l'État d'exécution ou cesse d'avoir sa résidence légale habituelle dans l'État d'exécution , l'autorité judiciaire compétente de l'État d'exécution transmet à l'autorité judiciaire compétente de l'État d'émission la compétence à l'égard de la surveillance des mesures de probation et des obligations ou injonctions constituant des peines de substitution ainsi que de toute autre décision en rapport avec l'exécution du jugement (ou le cas échéant de la décision de libération conditionnelle) .

(8) Whereas, having regard to the third paragraph of Article 3b of the Treaty, and with a view to ensuring transparency, this Directive lays down the minimum requirements needed to ensure an adequate level of customer information both before and after the execution of a cross-border credit transfer; whereas these requirements include indication of the complaints and redress procedures offered to customers, together with the arrangements for access thereto; whereas this Directive lays down minimum execution requirements, in particular in terms of performance, which institutions offering cross-border credit transfer services should adhere to, including the obligation to execute a cross-border credit transfer in accordance with the customer's instructions; whereas this Directive fulfils the conditions deriving from the principles set out in Commission Recommendation 90/109/EEC of 14 February 1990 on the transparency of banking conditions relating to cross-border financial transactions (6); whereas this Directive is without prejudice to Council Directive 91/308/EEC of 10 June 1991 on prevention of the use of the financial system for the purpose of money laundering (7);
(8) considérant que, conformément à l'article 3 B troisième alinéa du traité, et afin d'assurer la transparence, la présente directive établit les exigences minimales nécessaires pour assurer un niveau adéquat d'information de la clientèle, tant préalablement que postérieurement à l'exécution d'un virement transfrontalier; considérant que ces exigences comprennent une indication des procédures de réclamation et de recours offertes aux clients, ainsi que des modalités d'accès à celles-ci; que la présente directive établit des exigences d'exécution minimales, notamment en termes de qualité, auxquelles devront se conformer les établissements proposant des services de virements transfrontaliers, y compris l'obligation d'exécuter le virement transfrontalier conformément aux instructions du client; que la présente directive satisfait aux conditions découlant des principes énoncés dans la recommandation 90/109/CEE de la Commission, du 14 février 1990, concernant la transparence des conditions de banque applicables aux transactions financières transfrontalières (6); que la présente directive ne préjuge pas des dispositions de la directive 91/308/CEE du Conseil, du 10 juin 1991, relative à la prévention de l'utilisation du système financier aux fins du blanchiment de capitaux (7);

The Directive's main provisions provide for: - transparency: customer information, both beforehand on the conditions applying to cross-border transfers, and subsequently on the execution and receipt of a transfer; - periods of time (if there is no agreement between the bank and the customer) within which the establishment making the transfer and the beneficiary's establishment are bound to make the payment (5 days and 1 day respectively); - obligation to execute the transfer in accordance with the instructions in the payment order, particularly as regards the allocation of costs; - obligation, in the event of non-execution of transfers, to refund the full amount plus interest and charges.
Les dispositions principales de la directive prévoient: - la transparence : information de la clientèle, tant préalable sur les conditions applicables aux virements transnationales, qu'à posteriori sur l'exécution et la réception d'un virement ; - les délais, en l'absence d'un accord entre la banque et son client, dans lesquels l'établissement du donneur d'ordre et l'établissement du bénéficiaire sont tenus d'effectuer le virement (5 jours et un jour respectivement) ; - l'obligation d'effectuer le virement conformément aux instructions figurant sur l'ordre de paiement, notamment en ce qui concerne l'attribution des frais ; - en cas de défaillance dans les virements, l'obligation de remboursement du montant intégral, majoré d'un intérêt ainsi que du montant des frais.
