Where a third party is responsible for the disablement or death of a public office holder, the rights of that public office holder, or those entitled under that public office holder to bring legal proceedings against the third party, shall devolve on the Union to the extent to which it incurs obligations under the pension scheme.

3. The agreed arrangements to be established by common accord with a view to preserving the confidentiality of the information, in the case of confidential information communicated by the Commission pursuant to point 3.2 of Annex II to the Framework Agreement, or in the case of classified information forwarded by the Council pursuant to Article 5(4) of the Interinstitutional Agreement, shall be deposited, together with the confidential information, at the secretariat of the parliamentary body/office-holder or at the CIU, as the case may be.

5. EUCI classified as ‘TRÈS SECRET UE/EU TOP SECRET’ shall be transmitted to the European Parliament subject to further arrangements, to be agreed between the parliamentary body/office holder who submitted the request for the information and the EU institution or the Member State by whom it is communicated.

Les informations classifiées de l'UE classifiées au niveau «TRÈS SECRET UE/EU TOP SECRET» sont transmises au Parlement européen selon d'autres modalités, à convenir entre l'organe/titulaire d'un mandat au sein du Parlement européen qui a présenté la demande d'informations et l'institution de l'Union ou l'État membre qui les détient.

3. In the case of confidential information communicated by the Commission pursuant to the Framework Agreement, the agreed arrangements within the meaning of point 3.2 of Annex 2 to the Framework Agreement (laid down by common accord and concerning addressees, consultation procedure, i.e. secure reading room and meetings in camera, or other matters) designed to preserve the confidentiality of the information shall be deposited together with the confidential information at the secretariat of the parliamentary body/office holder or at the CIS when the information is classified as ‘CONFIDENTIEL UE/EU CONFIDENTIAL’ or above.
3. 1. If the Office does not reject the application for declaration of invalidity in accordance with Article 30, it shall communicate such application to the holder and shall request him/her to file his/her observations within such time limits as it may specify.
