The updated European list includes all carriers certified in 19 States, accounting for 276 known air carriers, whose operations are fully banned in the European Union: Afghanistan, Angola, Benin, Republic of Congo, the Democratic Republic of Congo, Djibouti, Equatorial Guinea, Gabon (with the exception of three carriers which operate under restrictions and conditions), Indonesia (with the exception of six carriers), Kazakhstan (with the exception of one carrier which operates under restrictions and conditions), the Kyrgyz Republic, Liberia, Mauritania, Philippines, Sierra Leone, Sao Tome and Principe, Sudan, Swaziland and Zambia.

4. If no air carrier has commenced or is about to commence scheduled air services on a route in accordance with the public service obligation which has been imposed on that route, the Member State concerned may limit access to the scheduled air services on that route to only one air carrier for a period of up to four years, after which the situation shall be reviewed.

This Regulation lays down the procedure to be followed in order to respond to unfair practices by non-Community air carriers which operate in competition with Community air carriers on specific routes to or from the Community and which, by virtue of these practices, cause significant material injury to Community air carriers on those routes, and to Community interests.

The Regulation defines "limited competition" as the conditions obtaining when, for example: - congested airports are served by fewer than three air carriers per route; - public service obligations exist; or - a given route is operated by only one carrier, or two carriers under a joint operation agreement.
