(15) The measures in the Lingua programme, adopted by Council Decision 89/489/EEC(7), were reinforced and partially integrated as horizontal measures into the Socrates programme adopted by Decision 819/95/EC of the European Parliament and the Council(8). Those measures have promoted the improvement of knowledge of the languages of the Union and have thus contributed to greater understanding and solidarity between the peoples of the Union. The European Parliament and Council in their Decision No 253/2000/EC(9) propose that those measures be further developed and reinforced in the second phase of the Socrates programme.

In that regard, the applicant maintains that, by restricting the number of languages from which individuals taking part in open competitions of the European Union may select their second language to three, the Commission in practice laid down a new rule concerning the languages of the institutions, impinging on the Council’s exclusive competence in that area.
La requérante affirme à cet égard que, en limitant à trois langues les langues susceptibles d’être choisies par les candidats comme langue 2 aux concours généraux de l’Union, la Commission a en pratique imposé un nouveau règlement linguistique des institutions, empiétant ainsi sur la compétence exclusive du Conseil en cette matière.

Firstly, the Council provision on ‘language’ gives more freedom to certain Member States to allow also other languages than the official one(s); secondly the Council had severe problems in accepting language-independent symbols which are currently neither harmonised nor well-known to customers.

The Council conclusions of 22 May 2008 on adult learning recognise the role of adult learning in addressing early school leaving by offering a second chance to those who reach adulthood without a qualification, focusing especially on basic skills, IT skills and language learning.
Dans ses conclusions du 22 mai 2008 sur l'éducation et la formation des adultes, le Conseil reconnaît le rôle que l'éducation et la formation des adultes jouent dans la lutte contre l'abandon scolaire en ce qu'elles offrent une seconde chance à ceux qui arrivent à l'âge adulte sans posséder de qualification, l'accent étant mis en particulier sur les compétences de base, les compétences dans le domaine des technologies de l'information et l'apprentissage des langues.

Secondly, the Council added a paragraph to Article 8, which stipulates that the Commission shall provide financial support to the Member States for the translation of the ADR (European Agreement concerning the International Carriage of Dangerous Goods by Road), RID (Regulations concerning International Carriage of Dangerous Goods by Rail) and ADN (European Agreement concerning the International Carriage of Dangerous Goods by Inland Waterways) and of their modifications into their respective official languages.

Calls on the Council to adopt a decision pursuant to Article 333(2) of the Treaty on the Functioning of the European Union stipulating that, when it comes to the proposal for a Council Regulation implementing enhanced cooperation in the area of the creation of unitary patent protection with respect to language arrangements for the European intellectual property rights pursuant to the second paragraph of Article 118 of the Treaty on the Functioning of the European Union, it will act under the ordinary legislative procedure;
invite le Conseil à adopter une décision sur la base de l'article 333, paragraphe 2, du traité sur le fonctionnement de l'Union européenne précisant que, s'agissant de la proposition de règlement du Conseil mettant en œuvre une coopération renforcée dans le domaine de la création d'une protection unitaire par brevet, en ce qui concerne les régimes linguistiques des titres européens visés à l'article 118, deuxième alinéa, du traité sur le fonctionnement de l'Union européenne, il statuera conformément à la procédure législative ordinaire;

2. The annual report to the Council, referred to in the second subparagraph of Article 32(1), shall be drawn up in the official languages of the Union institutions.
