Fourth plea in law, alleging infringement of fundamental rights, in so far as, by imposing restrictive measures on the applicant, the Council unlawfully restricted his freedom of movement and his right to property.

Fourth plea in law, alleging that the Council infringed, in an unjustified and disproportionate manner, the applicant’s fundamental rights to property and reputation as the restrictive measures were not provided for by law and were imposed without proper safeguards enabling the applicant to put his case effectively to the Council.

72. Urges the Hungarian authorities to implement as swiftly as possible all the measures the European Commission as the guardian of the treaties deems necessary in order to fully comply with EU law, fully comply with the decisions of the Hungarian Constitutional Court and implement as swiftly as possible the following recommendations, in line with the recommendations of the Venice Commission, the Council of Europe and other international bodies for the protection of the rule of law and fundamental rights, with a view to fully complying with the rule of law and its key requirements on the constitutional setting, the system of checks and balances and the independence of the judiciary, as well as on strong safeguards for fundamental rights, including freedom of expression, the media and religion or belief, protection of minorities, action to combat discrimination, and the right to property:
72. demande instamment aux autorités hongroises d'appliquer le plus rapidement possible toutes les mesures que la Commission européenne, en sa qualité de gardienne des traités, juge nécessaires afin de respecter pleinement le droit de l'Union, d'observer strictement les décisions de la Cour constitutionnelle hongroise et de mettre en œuvre dans les plus brefs délais les recommandations suivantes, au diapason des recommandations émanant de la commission de Venise, du Conseil de l'Europe et d'autres organes internationaux œuvrant à la protection de l'état de droit et des droits fondamentaux, en vue de se conformer à tous égards à l'état de droit et à ses principales exigences concernant le cadre constitutionnel, le système d'équilibre des pouvoirs et l'indépendance du pouvoir judiciaire, ainsi que de solides garanties pour les droits fondamentaux, dont la liberté d'expression, la liberté des médias, la liberté de religion ou de conviction, la protection des minorités, la lutte contre les discriminations et le droit à la propriété:

Third, that the Council decision and the Council Regulations amount to a breach of the applicant’s fundamental rights as protected by the EU Charter of Fundamental Rights and/or the European Convention of human Rights including the applicant’s right to human dignity, right to a good administration, right to an effective remedy and a fair trial, right to be presumed innocent and rights of defence, right to respect for his private and family life, home and communications, freedom to conduct a business, and his right to property.

15. Therefore calls on the Serbian Government to pursue its efforts to implement the Sarajevo Declaration, including by adopting a clear legal framework covering, inter alia, the right to return to the place of origin and the right to property compensation; urges the EU, its Member States and the international community to remain committed to upholding the rights of refugees, and to provide continuing support to the countries in question, including by earmarking sufficient financial resources to that end; emphasises that the integration or resettlement of IDPs and refugees should not significantly alter the original ethnic balance of an area or region; in this respect, draws attention to the Council of Europe's Framework Convention on the Protection of Minorities (1995);
15. demande donc au gouvernement serbe de poursuivre ses efforts en vue de la mise en œuvre de la déclaration de Sarajevo, notamment en adoptant un cadre juridique clair couvrant, entre autres, le droit au retour au lieu d'origine et le droit à dédommagement en matière immobilière; engage instamment l'Union européenne, ses États membres et la communauté internationale à continuer de défendre les droits des réfugiés et à fournir un soutien ininterrompu aux pays en question, notamment en affectant des ressources financières suffisantes à cette fin; souligne qu'il ne faut pas que l'intégration ou la réinstallation de DPI et de réfugiés modifie considérablement l'équilibre ethnique initial d'une zone ou d'une région; à cet égard, attire l'attention sur la convention-cadre du Conseil de l'Europe sur la protection des minorités (1995);

16. The Council is aware that, in the case of Titina Loizidou, the European Court of Human Rights considered that Turkey was in violation of the European Convention of Human Rights when that country was found guilty of depriving a person of the rights to property in Northern Cyprus.
Le Conseil est conscient que, dans le cas de Titina Loïzidis, la Cour européenne des droits de l'homme a estimé que la Turquie avait enfreint la Charte européenne des droits de l'homme en se rendant coupable d'une violation du droit de propriété dans le nord de Chypre et que cette même Cour a condamné la Turquie au paiement de dommages et intérêts.
