This provision needs to be adapted in the light of Article 3 of Commission Regulation (EC) No 493/2006 of 27 March 2006 laying down transitional measures within the framework of the reform of the common organisation of the markets in the sugar sector, and amending Commission Regulations (EC) No 1265/2001 and (EC) No 314/2002 , which provides for a preventive withdrawal, applicable to the share of the production under quota which exceeds the threshold established in accordance with paragraph 2 of that Article.

In order to ensure that the EERP is taken into account for the budget discipline, it is necessary to adapt the provisions concerning the budget ceiling for the expenditure financed by the European Agricultural Guarantee Fund (EAGF) referred to in Article 12 of Council Regulation (EC) No 1290/2005 by taking also into account the sums fixed under Heading 2 for the rural development under the recovery package in accordance with Council Decision 2009/434/EC of 25 May 2009 amending Decision 2006/493/EC laying down the amount of Community support for rural development for the period from 1 January 2007 to 31 December 2013, its annual breakdown and the minimum amount to be concentrated in regions eligible under the Convergence Objective and the amount for projects in the field of energy which could be decided in accordance with the procedure set out in the Declaration of the European Parliament, the Council and the Commission on the financing of projects in the field of energy and broadband Internet as well as the CAP Health Check in the framework of the European Economic Recovery Plan .

Whereas a transitional specimen health certificate was established pursuant to Article 16 of Directive 91/493/EEC by Commission Decision 93/185/EC of 15 March 1993 laying down certain transitional measures concerning the certification of fishery products from third countries in order to facilitate the switchover to the arrangements laid down in Council Directive 91/493/EEC(); whereas the period of application of that Decision is limited to 31 December 1994; whereas that transitional health certificate should remain in force pending the drawing up of provisional lists of approved establishments, in order to prevent any disruption of imports from third countries;
considérant qu'un modèle transitoire de certificat sanitaire a été établi, en application de l'article 16 de la directive 91/493/CEE, par la décision 93/185/CEE de la Commission, du 15 mars 1993, fixant certaines mesures transitoires en ce qui concerne la certification des produits de la pêche en provenance des pays tiers, afin de faciliter le passage au régime prévu par la directive 91/493/CEE du Conseil(); que la durée d'application de cette décision est limitée au 31 décembre 1994; qu'il importe, dès lors, dans l'attente de l'établissement des listes provisoires d'établissements agréés et pour éviter toute désorganisation des importations en provenance des pays tiers de maintenir en vigueur ce certificat sanitaire transitoire;

Without prejudice to Directive 90/675/EEC of 10 December 1990 laying down the principles governing the organization of veterinary checks on products entering the Community from third countries (5) and Directive 91/493/EEC of 22 July 1991 laying down the health conditions for the production and the placing on the market of fishery products (6), fishing vessels mentioned in Article 1 may not land their catches for release for free circulation and marketing except at ports designated by the Member States.
