24. Takes the view that, in keeping with the EU commitment to the rule of law and fundamental values, reforms in the areas of the judiciary and fundamental rights and of justice, freedom and security are urgently needed in Turkey; believes, furthermore, that delivering the official opening benchmarks for Chapters 23 (judiciary and fundamental rights) and 24 (justice, freedom and security) is an important step to promote truly effective reforms and to ensure that the reform process in Turkey is shaped on the basis of EU values and standards; reiterates its call for the Council, as soon as the set criteria have been fulfilled, to start negotiations on the judiciary and fundamental rights and on justice, freedom and security; calls on Turkey to cooperate as much as possible to this end; calls on the Commission to promote without delay further dialogue and cooperation with Turkey in the fields covered by chapters 23 and 24 to promote a common understanding on the reforms needed;
24. estime que, conformément à l'engagement pris par l'Union en faveur de l'état de droit et des valeurs fondamentales, il convient de mener d'urgence en Turquie des réformes au sein de l'appareil judiciaire, dans les domaines des droits fondamentaux et de la justice ainsi que de la liberté et de la sécurité; considère par ailleurs que le respect des critères d'ouverture officiels pour les chapitres 23 (appareil judiciaire et droits fondamentaux) et 24 (justice, liberté et sécurité) constitue une étape importante en vue d'encourager de réelles réformes et de garantir que le processus de réforme en Turquie soit modelé sur la base des valeurs et des normes de l'Union; demande à nouveau au Conseil d'engager, dès que les critères établis auront été remplis, des négociations sur l’appareil judiciaire et les droits fondamentaux ainsi que sur la justice, la liberté et la sécurité; invite, à cet effet, la Turquie à coopérer aussi étroitement que possible; demande à la Commission de promouvoir sans délai le dialogue et la coopération avec la Turquie dans les domaines relevant des chapitres 23 et 24 afin que les réformes nécessaires soient comprises de part et d'autre;

13. Notes that the Court of Justice has the highest proportion of staff working in the translation service among all Union institutions, having 47,3 % of its employees working as translators and interpreters; appreciates the obligations on the Court of Justice to handle proceedings in all 24 official languages of the Union and to translate all of its decisions into the official languages; believes, however, that there is room for the rationalisation of the translation services of the Court of Justice;

8. Emphasises the Commission’s new approach to address justice reforms and home affairs issues early in the accession process; observes however that on average only 3.13% of the total EU pre-accession envelope for 2007-2012 was devoted to justice and only 0.52% to the fight against corruption; notes that for the same period the total amount allocated to all policy areas covered by chapters 23 and 24 (Judiciary and Fundamental rights and Justice, Freedom and Security) is approximately 7.41% of the total pre-accession assistance; notes further that approximately 16.29% of funds allocated to Component I aim at strengthening the rule of law in candidate and potential candidate countries;

Neither Article 64 of the Rules of Procedure of the Court of First Instance nor Article 24 of the Statute of the Court of Justice, also applicable to the Court of First Instance pursuant to the first paragraph of Article 53 of that Statute, nor any other provision of the Rules of Procedure of the Court of First Instance and of the Statute of the Court of Justice, place any obligation on the Court of First Instance to advise the party lodging an action that his application is inadmissible when it has not been signed by a lawyer authorised to appear before the Community courts.

The Commission proposed a new Heading 3 "Citizenship, Freedom, Security and Justice in its proposal for the next financial framework of the Union (2007-2013) presented to Parliament and Council with a total allocation of EUR 24,705 billion out of which 65% were proposed to be addressed to the completion of an Area of Freedom, Security and Justice.
