In its appeal, brought under Article 9 of Annex I to the Statute of the Court of Justice of the European Union, the Commission of the European Communities is seeking to have set aside the judgment of the European Union Civil Service Tribunal (First Chamber) of 14 October 2008 in Case F‑74/07 Meierhofer v Commission [2008] ECR-SC I‑A‑1-0000 and II‑A-1-0000 (‘the judgment under appeal’), by which the Tribunal annulled the decision of the selection board in Competition EPSO/AD/26/05 of 19 June 2007 confirming that Mr Meierhofer had failed the oral test for that competition.
Par son pourvoi introduit au titre de l’article 9 de l’annexe I du statut de la Cour de justice de l’Union européenne, la Commission des Communautés européennes demande l’annulation de l’arrêt du Tribunal de la fonction publique de l’Union européenne (première chambre) du 14 octobre 2008, Meierhofer/Commission (F‑74/07, non encore publié au Recueil, ci-après l’« arrêt attaqué »), par lequel celui-ci a annulé la décision du 19 juin 2007 du jury du concours EPSO/AD/26/05 confirmant l’échec du requérant en première instance à l’épreuve orale dudit concours.

APPEAL against the judgment of the European Union Civil Service Tribunal (First Chamber) of 14 October 2008 in Case F‑74/07 Meierhofer v Commission [2008] ECR-SC I‑A‑1-0000 and II‑A-1-0000 seeking to have that judgment set aside,
ayant pour objet un pourvoi formé contre l’arrêt du Tribunal de la fonction publique de l’Union européenne (première chambre) du 14 octobre 2008, Meierhofer/Commission (F‑74/07, non encore publié au Recueil), et tendant à l’annulation de cet arrêt,

It follows that, notwithstanding the differences between the Rules of Procedure of the General Court and those of the Civil Service Tribunal, the latter is none the less entitled to follow the same procedure as that followed by the General Court, namely, when a party informs the court that it is not able to comply with measures of organisation of procedure since some of the requested documents are confidential, that court can order that party to produce the requested documents, but provide that they will not be communicated to the other party at that stage (see, to that effect, Case T‑48/05 Franchet and Byk v Commission [2008] ECR II‑1585, paragraphs 54 and 55, and Case T‑299/05 Shanghai Excell M E Enterprise and Shanghai Adeptech Precision v Council [2009] ECR II‑0000, paragraphs 24 to 26).
Il en découle que, malgré les différences existant entre le règlement de procédure du Tribunal et celui du Tribunal de la fonction publique, il demeure possible à ce dernier de suivre la même procédure que celle suivie par le Tribunal, selon laquelle, lorsqu’une partie informe le juge qu’elle estime ne pas être en mesure de donner suite à des mesures d’organisation de la procédure dès lors que certains des documents sollicités seraient confidentiels, celui-ci peut adopter une ordonnance enjoignant à cette partie de produire les documents en cause tout en prévoyant qu’ils ne seront pas communiqués à la partie adverse à ce stade (voir, en ce sens, arrêts du Tribunal du 8 juillet 2008, Franchet et Byk/Commission, T‑48/05, Rec. p. II‑1585, points 54 et 55, et du 18 mars 2009, Shanghai Excell M E Enterprise et Shanghai Adeptech Precision/Conseil, T‑299/05, non encore publié au Recueil, points 24 à 26).

In the absence of such reasons, even a marginal review by the Commission on the basis of both the first Altmark condition and Article 86(2) EC with respect to the existence of a manifest error by the Member State in the context of its discretion would not be possible, Case T-289/03, BUPA and Others v Commission [2008] ECR II-0000, paragraph 172.
