13 (1) Where the spouse has received, as an employee benefit, options to purchase shares of a Canadian-controlled private corporation, or a publicly traded corporation that is subject to the same tax treatment with reference to stock options as a Canadian-controlled private corporation, and has exercised those options during the year, add the difference between the value of the shares at the time the options are exercised and the amount paid by the spouse for the shares, and any amount paid by the spouse to acquire the options to purchase the shares, to the income for the year in which the options are exercised.

(2) A person who ceased to be employed in the Public Service before October 15, 2000, who attempted to transfer his or her pensionable service pursuant to an agreement of the type contemplated by subsection 40(2) of the Act and who exercised an option under section 12, 13 or 13.01 of the Act or is deemed under paragraph 10(5)(a) or (b) of the Act to have exercised an option may, with the consent of the Minister, revoke the option and exercise a new option under those sections if he or she has not yet received a benefit under the Act and the transfer could not be validly completed.

21 (1) A person who ceased to be employed in the Public Service, who was employed by an eligible employer and who exercised an option under section 12, 13 or 13.01 of the Act or is deemed under paragraph 10(5)(a) or (b) of the Act to have exercised an option may, with the consent of the Minister, revoke the option and exercise a new option under those sections if he or she has not yet received a benefit under the Act and either of the following conditions are met:

(b) if he ceases to be so employed having to his credit ten years or more but less than twenty years of operational service that is pensionable service, he is entitled, at his option on ceasing to be employed in the public service, to an annual allowance in respect of that service in respect of which he has not exercised an option under subsection (2) in lieu of any benefit under subsection 13(1) in respect of that service, payable immediately on his exercising his option, equal to the amount of the deferred annuity that would be payable under subsection 13(1) in respect of that service reduced by the product obtained by multiplying five per cent of the amount of that annuity by twenty minus the number of years, to the nearest one-tenth of a year, of his operational service that is pensionable service, with a maximum reduction of thirty per cent.

(6) When, under any of sections 12 to 13.001, a contributor is entitled to a benefit specified in that section at his or her option, the option may be revoked and a new option exercised by the contributor, under the circumstances and on the terms and conditions that the Governor in Council by regulation prescribes.
