Article 37 of Regulation (EC) No 1782/2003 as amended by Regulation (EC) No 864/2004 provides that for the olive oil sector, the reference amount corresponding to the individual farmers is the four-year average of the total amount of payments which a farmer was granted under the olive oil production aid, calculated and adjusted according to Annex VII to that Regulation, during the marketing years 1999/2000, 2000/01, 2001/02 and 2002/03.
L’article 37 du règlement (CE) no 1782/2003, modifié par le règlement (CE) no 864/2004, dispose que, en ce qui concerne l'huile d'olive, le montant de référence est la moyenne sur quatre ans des montants totaux des paiements accordés à un agriculteur au titre du régime de soutien à l'huile d'olive, calculé et adapté conformément à l'annexe VII dudit règlement, au cours des campagnes 1999/2000, 2000/2001, 2001/2002 et 2002/2003.

The following subparagraph is hereby added to Article 63(9) of Regulation (EC) No 1623/2000: "However, for the 2001/02 marketing year, the wines listed in the contracts concluded with Portugal for distillation under Article 1 of Regulation (EC) No 378/2002 can be delivered until 31 July 2002".

(3) Article 5(3)(a) of Regulation (EC) No 2201/96 lays down that for the 2001/02 marketing year the aid fixed in Article 4(2) of that Regulation is to be reduced to EUR 31,36/tonne and that a supplement is to be paid after the end of the marketing year in the Member States that have not exceeded their threshold by more than 10 %. Point (b) of that Article lays down that for the 2002/03 marketing year, the overrun of the processing threshold is to be calculated on the basis of the quantity supplied for processing with aid during the 2001/02 marketing year.
(3) L'article 5, paragraphe 3, du règlement (CE) n° 2201/96 prévoit au point a) que, pour la campagne 2001/2002, l'aide fixée à l'article 4, paragraphe 2, dudit règlement est ramenée à 31,36 euros par tonne et qu'un montant supplémentaire d'aide est versé dans les États membres n'ayant pas dépassé leur seuil de plus de 10 % et au point b) que le dépassement du seuil de la campagne 2002/2003 est calculé sur la base des quantités livrées à la transformation avec aide lors de la campagne 2001/2002.

(5) The aid to be applied for the 2001/02 and 2002/03 marketing years in the Member States that have not exceeded their threshold is the amount fixed in Article 4(2) of Regulation (EC) No 2201/96 and the supplement to be paid for the 2001/02 marketing year bridges the difference between that amount and the amount referred to in the second indent of Article 5(3)(a) of that Regulation.
(5) Dans les États membres n'ayant pas dépassé leur seuil, l'aide à appliquer pour les campagnes 2001/2002 et 2002/2003 est le montant fixé à l'article 4, paragraphe 2, du règlement (CE) n° 2201/96 et le montant supplémentaire à verser au titre de la campagne 2001/2002 comble la différence entre le montant précité et le montant visé à l'article 5, paragraphe 3, point a), deuxième tiret, dudit règlement.

(6) In the other Member States, the aid to be applied for the 2001/02 and 2002/03 marketing years is the amount fixed in Article 4(2) of Regulation (EC) No 2201/96 reduced by the threshold overruns, or by the sub-threshold overruns in the case of Spain, following the distribution, in accordance with and the third subparagraph of Article 5(2) and the third subparagraph of Article 5(4) of that Regulation, of the quantities or sub-quantities still available and the supplement to be paid for the 2001/02 marketing year bridges the difference between that amount and the amount of aid referred to in the second indent of Article 5(3)(a) of that Regulation.
