Il convient d'établir les modalités selon lesquelles l'ordonnateur habilité par la Commission établit les mesures nécessaires, avec les États d'Afrique, des Caraïbes et du Pacifique (ci-après dénommés «États ACP») et les pays et territoires d'outre-mer (PTOM), pour assurer la bonne exécution des opérations, en étroite coopération avec l'ordonnateur national, régional, intra-ACP ou territorial désigné par les États ACP ou les PTOM.
Detailed rules should be established in accordance with which the authorising officer empowered by the Commission establishes the necessary arrangements with the African, Caribbean and Pacific (ACP) group of States (‘the ACP States’) and the overseas countries and territories (‘OCTs’) to ensure the proper execution of operations, in close cooperation with the national, regional, intra-ACP or territorial authorising officer designated by the ACP States or OCTs.

Afin d'effectuer les paiements visés à l'article 37, paragraphes 1 et 4, de l'annexe IV de l'accord ACP-CE ou par les mesures de mise en œuvre de la décision d'association outre-mer, le comptable ouvre, le cas échéant, des comptes auprès d'institutions financières des États ACP et des PTOM pour les paiements en monnaie nationale des États ACP ou en monnaie locale des PTOM, et auprès d'institutions financières des États membres pour les paiements en euros et autres devises.
1. In order to make the payments provided for in Article 37(1) and (4) of Annex IV to the ACP-EC Agreement or in the measures implementing the Overseas Association Decision, the accounting officer shall open accounts, where appropriate, with financial institutions in the ACP States and the OCTs, for payments in the national currencies of the ACP States or in the local currencies of the OCTs, and with financial institutions in the Member States, for payments in euro and other currencies.

Pursuant to Article 1(1) of Protocol 3 on ACP sugar (hereinafter referred to as the ACP Protocol) attached to Annex V to the Partnership Agreement between the members of the African, Caribbean and Pacific Group of States, of the one part, and the European Community and its Member States, of the other part, signed in Cotonou on 23 June 2000 (2) (hereinafter referred to as the ACP-EC Partnership Agreement), and Article 1(1) of the Agreement between the European Economic Community and the Republic of India on cane sugar (3) (hereinafter referred to as the Agreement with India), the Community undertakes to purchase and import, at guaranteed prices, specific quantities of cane sugar which originate in the ACP States and India respectively and which those States undertake to deliver to it.

In the conclusion or implementation of such agreements, the ACP States shall not discriminate against the Community or among the Member States, without prejudice to special arrangements between developing States within the same geographical area, including reciprocal fishing arrangements, nor shall the Community discriminate against ACP States.

In the conclusion or implementation of such agreements, the ACP States shall not discriminate against the Community or among the Member States, without prejudice to special arrangements between developing States within the same geographical area, including reciprocal fishing arrangements, nor shall the Community discriminate against ACP States.

CONSIDÉRANT que l'accord de Georgetown, du 6 juin 1975, a créé le groupe des États ACP et a institué un Conseil des ministres ACP et un Comité des ambassadeurs; que le fonctionnement des organes du groupe des États ACP doit être géré par les secrétariat des États ACP.
WHEREAS the Georgetown Agreement of 6 June 1975 constituted the ACP Group of States and instituted a Council of ACP Ministers, and a Committee of Ambassadors; whereas the organs of the ACP Group of States are to be serviced by the Secretariat of the ACP States.

Au sens du présent accord, on entend par "sociétés ou entreprises d'un État membre ou d'un État ACP", les sociétés ou entreprises de droit civil ou commercial - y compris les sociétés publiques ou autres, les sociétés coopératives et toute autre personne morale et association régies par le droit public ou privé, à l'exception des sociétés à but non lucratif - constituées en conformité avec la législation d'un État membre ou d'un État ACP et ayant leur siège statutaire ou leur administration centrale, ou leur principal établissement dans un État membre ou un État ACP.
1. For the purpose of this Agreement, "companies or firms of a Member State or an ACP State" mean companies or firms constituted under civil or commercial law, including corporations, whether public or otherwise, cooperative societies and other legal persons and partnerships governed by public or private law, save for those which are non-profit-making, formed in accordance with the law of a Member State or an ACP State and whose statutory office, central administration or principal place of business is a Member State or an ACP State.

2) les "importations non traditionnelles des États ACP" correspondent aux quantités exportées par les États ACP qui dépassent la quantité définie au point 1; les bananes qui font l'objet de ces importations sont dénommées ci-après "bananes non traditionnelles ACP";
(b) "non-traditional imports from ACP States" means the quantities of bananas exported by the ACP States which exceed the quantity defined in 1; such bananas shall be referred to as "non-traditional bananas";
