(11) Afin de simplifier la législation de l’Union sur la réception par type, conformément aux recommandations de 2007 du rapport CARS 21 , il est approprié de fonder le présent règlement sur les règlements CEE-ONU n° 51 sur les émissions de bruit pour ce qui concerne la méthode d’essai et n° 59 sur les dispositifs silencieux d’échappement pour ce qui concerne les dispositifs silencieux d’échappement de remplacement.
(11) In order to simplify the type-approval legislation of the Union, in line with the 2007 recommendations of the CARS 21 Report , it is appropriate to base this Regulation on UNECE Regulations No 51 on noise emissions with regards to the test method and No 59 on silencing systems with regard to replacement exhaust silencing systems.

Les États membres ne peuvent, pour des motifs concernant le niveau sonore admissible ou le dispositif d'échappement, refuser la réception CE ni la réception nationale d'un élément d'un dispositif d'échappement considéré comme entité technique:
No Member State may, on grounds relating to the permissible sound level or the exhaust system, refuse to grant EC or national type-approval in respect of a component of an exhaust system regarded as a separate technical unit:

1. Les États membres ne peuvent, pour des motifs concernant le niveau sonore admissible ou le dispositif d'échappement, interdire la mise en circulation d'un élément d'un dispositif d'échappement qui est considéré comme entité technique au sens de l'article 3, point 25, de la directive 2007/46/CE, si celui-ci, au sens de l'article 3 de la présente directive, correspond à un type pour lequel la réception a été accordée.
1. No Member State may, on grounds relating to the permissible sound level or the exhaust system, prohibit the placing on the market of any component of an exhaust system considered as a separate technical unit within the meaning of point 25 of Article 3 of Directive 2007/46/EC if, within the meaning of Article 3 of this Directive, it is of a type in respect of which a type-approval has been granted.

3.1. Les éléments des dispositifs silencieux d’échappement et d’admission, à l’exception des pièces de fixation et des tuyaux, doivent porter:

Par «élément d'un dispositif silencieux d'échappement ou d'admission», on entend un des composants isolés dont l'ensemble forme le dispositif d'échappement (par exemple : tuyaux d'échappement, le silencieux proprement dit) ou le dispositif d'admission (par exemple : filtre à air).
"Component of an exhaust or intake system" means one of the separate components which together form the exhaust system (e.g. exhaust pipes, the silencer proper) or the intake system (e.g. air filter).

II. DISPOSITIF D'ÉCHAPPEMENT (SILENCIEUX) II. 1 Si le tracteur est muni de dispositifs destinés à réduire le bruit de l'échappement (silencieux), on observe les prescriptions du présent point II. Si le tuyau d'aspiration du moteur est équipé d'un filtre à air, nécessaire pour assurer le respect du niveau sonore admissible, ce filtre est considéré comme faisant partie du silencieux et les prescriptions du présent point II sont aussi applicables à ce filtre.
II. EXHAUST SYSTEM (SILENCER) II. 1. If the tractor is fitted with a device designed to reduce the exhaust noise (silencer), the requirements of this Item II shall apply. If the inlet of the engine is fitted with an air filter which is necessary in order to ensure compliance with the permissible sound level, the filter shall be considered to be part of the silencer, and the requirements of this Item II shall also apply to that filter.
