104. déplore le contenu de l'accord politique du 6 octobre 2015 au sein du Conseil, qui n'est pas à la hauteur de la proposition législative de la Commission présentée en mars 2015 modifiant la directive 2011/16/UE en ce qui concerne l'échange automatique et obligatoire d'informations dans le domaine fiscal; souligne que celle-ci prévoyait, en plus d'un cadre commun en matière d'enregistrement et d'échange automatique d'informations sur les rescrits, des dispositions permettant à la Commission d'en contrôler efficacement la mise en application par les États membres tout en veillant à ce que les rescrits ne portent pas préjudice au marché intérieur; souligne que l'adoption de la position du Conseil empêcherait de tirer pleinement parti de l'échange automatique d'informations sur les rescrits fiscaux, en particulier en termes de mise en œuvre effective, et invite donc le Conseil à s'en tenir à la proposition de la Commission et à tenir dûment compte de l'avis du Parlement sur le sujet, en particulier en ce qui concerne le champ d'application de la directive (tous les rescrits fiscaux et pas seulement les rescrits transfrontaliers), la période de rétroactivité (tous les rescrits fiscaux encore valides seraient échangés) et les informations à fournir à la Commission, qui devrait avoir accès aux rescrits fiscaux;

Deplores the content of the political agreement of 6 October 2015 within the Council, which falls short of the Commission’s legislative proposal of March 2015 amending Directive 2011/16/EU as regards mandatory automatic exchange of information in the field of taxation; stresses that the latter provided, on top of a common framework for the registration and automatic exchange of information on rulings, provisions allowing the Commission to effectively monitor its implementation by Member States and ensure that rulings do not have a negative impact on the internal market; stresses that the adoption of the Council’s position would prevent drawing all benefits from the automatic exchange of rulings, in particular in terms of effective implementation, and calls on the Council, therefore, to stick to the Commission’s proposal and take due account of the Parliament’s opinion thereon, in particular as regards the scope of the directive (all tax rulings instead of cross-border only), the retroactivity period (all tax rulings still valid should be exchanged) and the information provided to the Commission, which should have access to the tax rulings;

The processing of personal data provided by this Directive is appropriate for attaining the legitimate aims pursued by this Directive in the field of road safety, namely to ensure a high level of protection for all road users in the Union by facilitating the cross-border exchange of information on road-safety-related traffic offences and, thereby, the enforcement of sanctions, and does not exceed what is appropriate and necessary in order to achieve those objectives.

La présente directive vise à assurer un niveau élevé de protection de tous les usagers de la route dans l'Union en facilitant l'échange transfrontalier d'informations concernant les infractions en matière de sécurité routière et en facilitant ainsi l'application des sanctions, lorsque lesdites infractions ont été commises dans un État membre autre que celui où le véhicule en cause a été immatriculé.
This Directive aims to ensure a high level of protection for all road users in the Union by facilitating the cross-border exchange of information on road-safety-related traffic offences, and thereby facilitating the enforcement of sanctions, where those offences are committed with a vehicle registered in a Member State other than the Member State in which the offence took place.

Étant donné que l'objectif de la présente directive, à savoir assurer un niveau élevé de protection pour tous les usagers de la route dans l'Union en facilitant l'échange transfrontalier d'informations concernant les infractions en matière de sécurité routière commises dans un autre État membre que celui où le véhicule en cause a été immatriculé, ne peut pas être atteint de manière suffisante par les États membres mais peut, en raison des dimensions et des effets de l'action, l'être mieux au niveau de l'Union, celle-ci peut prendre des mesures conformément au principe de subsidiarité consacré à l'article 5 du traité sur l'Union européenne.
Since the objective of this Directive, namely to ensure a high level of protection for all road users in the Union by facilitating the cross-border exchange of information on road-safety-related traffic offences, where they are committed with a vehicle registered in a Member State other than the Member State where the offence took place, cannot be sufficiently achieved by the Member States, but can rather, by reason of the scale and effects of the action, be better achieved at Union level, the Union may adopt measures, in accordance with the principle of subsidiarity, as set out in Article 5 of the Treaty on European Union.

À cet effet, un système d'échange transfrontalier d'informations devrait être utilisé pour certaines infractions déterminées en matière de sécurité routière, qu'elles soient de nature administrative ou pénale au regard de la loi de l'État membre concerné, ce qui permettrait à l'État membre de l'infraction d'accéder aux données relatives à l'immatriculation des véhicules de l'État membre d'immatriculation.

Il s'agit de plateformes qui facilitent l'interopérabilité et la coopération entre États membres dans des domaines d'intérêt commun, notamment en vue d'améliorer le fonctionnement du marché intérieur, en particulier la justice en ligne, qui permettront aux citoyens, aux entreprises, aux organisations et aux praticiens de la justice de disposer en ligne d'un accès transfrontalier à des ressources et documents juridiques et à des procédures judiciaires; le mécanisme de règlement en ligne des litiges (RLL), qui permettra de régler en ligne les litiges transfrontaliers entre consommateurs et commerçants, et le système d'échange électronique d'informations sur la sécurité sociale (EESSI), qui aidera les organismes de sécurité sociale dans l'Union à échanger des informations plus rapidement et en toute sécurité.
This refers to platforms which shall facilitate interoperability and cooperation between Member States in areas of common interest, particularly with a view to improving the functioning of the internal market, such as eJustice, which will enable online cross-border access by citizens, businesses, organisations and legal practitioners to legal resources/documents and judicial procedures, Online Dispute Resolution (ODR) which will enable online resolution of cross-border disputes between consumers and merchants and Electronic Exchange of Social Security Information (EESSI), which will help social security bodies across the Union exchange information more rapidly and securely.

55. se félicite, en particulier, de l'objectif visant à réaliser l'échange transfrontalier d'informations relatives aux services de renseignement et de sécurité, conformément au principe de la disponibilité contenu dans le programme de La Haye, lequel est prévu pour l'échange ultérieur d'informations relatives à des faits pouvant faire l'objet de poursuites pénales, moyennant quoi - en tenant compte des conditions spécifiques des méthodes de travail de ces services (par exemple nécessité de préserver au terme de l'échange la procédure de collecte des informations, les sources d'information et la confidentialité des données) - des informations qui seront disponibles auprès d'un service d'un État membre seront mises à la disposition des services correspondants d'un autre État membre;

Welcomes in particular the objective of arranging for the cross-border exchange of intelligence and security service information in accordance with the principle of availability set out in the Hague Programme – where it relates to the future exchange of law-enforcement information – a principle whereby, taking into account the special nature of these services" methods (e.g. the need to protect the information-gathering procedure, information sources and the continued confidentiality of data after exchange), information available to a service in one Member State should be made available to the corresponding services in another Member State;
