6. EBA shall develop draft regulatory technical standards specifying the framework for cooperation, and for the exchange of information, between the competent authorities of the home Member State and of the host Member State in accordance with this Title and to monitor compliance with the provisions of national law transposing Titles III and IV. The draft regulatory technical standards shall specify the method, means and details of cooperation in the supervision of payment institutions operating on a cross-border basis and, in particular, the scope and treatment of information to be exchanged, to ensure consistent and efficient supervision of payment institutions exercising cross-border provision of payment services.

Annex III to the VTMIS Directive which covers the Union Maritime Information and Exchange system and refers to other relevant Union legislation, should be made more explicit by specifying those Union acts in regard to which SafeSeaNet is currently used, such as Directive 2000/59/EC of the European Parliament and of the Council (3), Directive 2005/35/EC of the European Parliament and of the Council (4), Directive 2009/16/EC of the European Parliament and of the Council (5) and Directive 2010/65/EU of the European Parliament and of the Council (6); in regard to the mentioned legal acts, the use of SafeSeaNet can further facilitate the exchange and sharing of information and should further facilitate the use of the system, the integrated information system and a platform to ensure the convergence and interoperability of maritime systems and applications, including space-based technologies.

In order to ensure uniform conditions of application in relation to the coordination and exchange of information between supervisory authorities, EIOPA shall develop draft implementing technical standards on the procedures and templates for the submission of information to the group supervisor as well as the procedure for the cooperation and the exchange of information between supervisory authorities as laid down in this Article.

In 2006 and 2007, the Commission presented a comprehensive legislative package consisting of three instruments: Council Framework Decision 2008/675/JHA obliging Member States to take account of previous convictions in new criminal proceedings; Council Framework Decision 2009/315/JHA on the organisation and content of the exchange of information extracted from criminal records; and Council Decision 2009/316/JHA establishing ECRIS as the technical means of exchanging information extracted from criminal records.[47] Due to be implemented by April 2012, Council Framework Decisions 2009/315/JHA and 2009/316/JHA aim to define the ways in which a convicting Member State must transmit information concerning a new conviction to the Member State(s) of the convicted person’s nationality, storage obligations, and a framework for a computerised system of information exchange.
