Les échanges automatiques d'informations au titre de l'article 8 sont effectués dans un format informatique standard conçu pour faciliter cet échange automatique et basé sur le format informatique existant en vertu de l'article 9 de la directive 2003/48/CE, qui doit être utilisé pour tous les types d'échanges automatiques d'informations et qui est adopté par la Commission conformément à la procédure visée à l'article 26, paragraphe 2».
The automatic exchange of information pursuant to Article 8 shall be sent using a standard computerised format aimed at facilitating such automatic exchange and based on the existing computerised format pursuant to Article 9 of Directive 2003/48/EC, to be used for all types of automatic exchange of information, adopted by the Commission in accordance with the procedure referred to in Article 26(2)’.

In 2006 and 2007, the Commission presented a comprehensive legislative package consisting of three instruments: Council Framework Decision 2008/675/JHA obliging Member States to take account of previous convictions in new criminal proceedings; Council Framework Decision 2009/315/JHA on the organisation and content of the exchange of information extracted from criminal records; and Council Decision 2009/316/JHA establishing ECRIS as the technical means of exchanging information extracted from criminal records.[47] Due to be implemented by April 2012, Council Framework Decisions 2009/315/JHA and 2009/316/JHA aim to define the ways in which a convicting Member State must transmit information concerning a new conviction to the Member State(s) of the convicted person’s nationality, storage obligations, and a framework for a computerised system of information exchange.

(3) Whereas the internal market constitutes an area without borders, within which the free movement of goods, persons, capital and services has to be ensured, and where Community measures already adopted or in the process of being adopted require significant exchange of information between individuals, economic operators and administrations; whereas the fact of possessing efficient means of exchanging information is of vital importance for improving the competitiveness of undertakings; whereas these exchanges of information can be ensured by trans-European telecommunications networks; whereas the availability of trans-European networks will strengthen social and economic cohesion in the Community;

The Council: 1. reaffirms the importance of reinforcing coordination in development cooperation between the Community and the Member States as stated in Article 130x of the Treaty on European Union and in accordance with the principle of complementarity of policies set out in Article 130u; 2. notes with interest the initial results of reinforced coordination in the six pilot countries, in particular the progress made in several countries in reciprocal exchange of information between the representatives of the Member States and the Community and the consequent greater transparency of sectoral and regional activities of the Commission and Member States; 3. notes, however, the disparity between one country and another in the functioning of coordination and observes that the process is hindered by a number of problems relating, inter alia, to lack of staff, links with other coordination bodies and the involvement of beneficiary countries; 4. also emphasizes, in view of the differing economic and social situations in the various countries, the advantages of coherent analysis and exchange of information between the Member States and the Commission; 5. stresses the importance of Community coordination and reiterates the main objectives, which are: to strengthen the capacity of the recipient country to assume responsibility for and ownership of its own development strategies and programmes; to reduce the administrative burden on beneficiary countries with the aim of encouraging strengthened capacity; to increase the effectiveness of development cooperation by the Community and its Member States and providers of funds as a whole; to ensure consistency of the cooperation activities of the Community and its Member States with the common political guidelines adopted by the Council and to ensure complementarity of the various measures within the framework of a single strategy developed by the beneficiary country itself; to optimize the European Union's presence in develo ...
