L'ouverture à la concurrence des services internationaux de transport ferroviaire de voyageurs peut avoir des conséquences sur l'organisation et le financement des services de transport ferroviaire de voyageurs fournis en vertu d'un contrat de service public conformément au règlement (CE) no 1370/2007 du Parlement européen et du Conseil (2).
Opening up international rail passenger services to competition may have implications for the organisation and financing of rail passenger services provided under a public service contract in accordance with Regulation (EC) No 1370/2007 of the European Parliament and of the Council (2).

(2) Une série de mesures législatives ont été adoptées au niveau européen, ouvrant à la concurrence le marché du fret ferroviaire ainsi que le marché des services internationaux de transport de voyageurs par chemin de fer et définissant certains principes fondamentaux dans la directive 2012/34/UE du Parlement européen et du Conseil, du 21 novembre 2012 établissant un espace ferroviaire unique européen (refonte)1 . Ces principes comprennent notamment les éléments suivants: les entreprises ferroviaires doivent être gérées selon les principes applicables aux sociétés commerciales, les entités responsables de la répartition des capacités et de la tarification de l’infrastructure ferroviaire doivent être séparées des entités qui exploitent les services ferroviaires, il doit y avoir une séparation comptable, toute entreprise ferroviaire disposant d’une licence conforme aux critères UE devrait pouvoir accéder à l’infrastructure ferroviaire dans des conditions équitables et non discriminatoires, et les gestionnaires de l’infrastructure peuvent bénéficier d’un financement public.
(2) A series of legislative measures has been adopted at European level, opening up the rail freight and international rail passenger markets to competition and establishing, by way of Directive 2012/34/EU of the European Parliament and of the Council of 21 November 2012 establishing a single European railway area (recast)3a , certain fundamental principles which include that railway undertakings shall be managed according to principles that apply to commercial companies, that entities responsible for the allocation of capacity and charging for rail infrastructure shall be separate from entities which operate rail services and that there shall be a separation of accounts, that any railway undertaking licensed in accordance with EU criteria should have access to railway infrastructure on fair, non-discriminatory terms, and that infrastructure managers may benefit from State financing.

In reply to passengers who complain that they waste time unnecessarily because they have to buy another ticket once they have crossed the border, the Commission says that it came up with a good proposal but that the European Parliament blocked it.

Any Member State applying border controls for the protection of European Council meetings or comparable events, in particular under Article 2(2) of the Schengen Convention, may also take every step to limit, as far as possible, the inconvenience caused by checks on travellers; precedence should accordingly be given to intelligence-led checks focused on individuals in respect of whom there are substantial grounds for believing that they intend to enter the Member State with the aim of disrupting public order and security at the event or committing offences relating to the event.

Not later than 1 August 2005 the Commission shall, after consulting the Member States and management and labour at European level, review the operation of the provisions with regard to workers concerned with the carriage of passengers on regular urban transport services, with a view to presenting, if need be, the appropriate modifications to ensure a coherent and suitable approach in the sector.

L’article 26 de la Directive dispose qu’« [a]u plus tard le 1 er août 2005, et après avoir consulté les États membres, les employeurs et les travailleurs au niveau européen, la Commission examine le fonctionnement de ces dispositions en ce qui concerne les travailleurs du secteur du transport de voyageurs sur des services de transport urbain régulier, afin de présenter au besoin les modifications appropriées afin d'assurer une approche cohérente et adaptée dans ce secteur ».
Article 26 of the Directive lays down that " not later than 1 August 2005 the Commission shall, after consulting the Member States and management and labour at European level, review the operation of the provisions with regard to workers concerned with the carriage of passengers on regular urban transport service, with a view to presenting, if need be, the appropriate modifications to ensure a coherent and suitable approach in the sector" .
