Les dispositions de la présente directive sont sans préjudice des dispositions du droit communautaire concernant les conditions de sécurité dans lesquelles il convient de transporter les agents biologiques et les organismes génétiquement modifiés, lesquels sont régis par la directive 90/219/CEE du Conseil du 23 avril 1990 relative à l’utilisation confinée de micro-organismes génétiquement modifiés (6), la directive 2001/18/CE du Parlement européen et du Conseil du 12 mars 2001 relative à la dissémination volontaire d’organismes génétiquement modifiés dans l’environnement (7) et la directive 2000/54/CE du Parlement européen et du Conseil du 18 septembre 2000 concernant la protection des travailleurs contre les risques liés à l’exposition à des agents biologiques au travail (8).
The provisions of this Directive are without prejudice to the Community legislation governing the safety conditions under which biological agents and genetically modified organisms, regulated under Council Directive 90/219/EEC of 23 April 1990 on the contained use of genetically modified micro-organisms (6), Directive 2001/18/EC of the European Parliament and of the Council of 12 March 2001 on the deliberate release into the environment of genetically modified organisms (7) and Directive 2000/54/EC of the European Parliament and of the Council of 18 September 2000 on the protection of workers from risks related to exposure to biological agents at work (8), should be transported.

On 13 April 2007, Poland notified the Commission, on the basis of Article 95(5) of the EC Treaty, of Articles 111 and 172 of a draft act entitled ‘Law on Genetically Modified Organisms’, containing national provisions derogating from Directive 2001/18/EC of the European Parliament and of the Council of 12 March 2001 concerning the deliberate release into the environment of genetically modified organisms (1).
