Every grant, lease, permit, licence or other disposition respecting the exploitation of oil or gas in Indian lands, whether granted, issued, made or entered into before or after December 20, 1974, and, without restricting the generality of the foregoing, any grant, lease, permit, licence or other disposition respecting oil or gas or both oil and gas issued or made or purported to be issued or made pursuant to any other regulation or order made under the provisions of the Indian Act is deemed to be subject to any regulations made under this Act.

In accordance with Article 28 of the Train Drivers Directive, the Agency shall, in a report to be presented by 4 June 2009, and taking into account the TSI on operation and traffic management developed under Directives 96/48/EC and 2001/16/EC, identify the profile and tasks of other crew members performing safety-critical tasks whose professional qualifications accordingly contribute to railway safety which should be regulated at Community level by means of a system of licences and/or certificates which may be similar to the system established by the Train Drivers Directive’.

L’Agence détermine, dans un rapport à présenter au plus tard le 4 juin 2009 et en tenant compte des STI en matière de gestion du trafic et des opérations de trafic élaborées en vertu des directives 96/48/CE et 2001/16/CE, le profil et les tâches des autres personnels de bord assurant des tâches déterminantes pour la sécurité et dont les qualifications professionnelles concourent ainsi à la sécurité ferroviaire, et qui devraient être réglementés au niveau communautaire au moyen d’un système de licences et/ou d’attestations pouvant être analogue à celui qui est mis en place par la présente directive.
