– vu les avis nos CDL(2011)016, CDL(2011)001, CDL-AD(2012)001, CDL-AD(2012)009, CDL-AD(2012)020 et CDL-AD(2012)004 de la commission européenne pour la démocratie par le droit (commission de Venise) concernant la nouvelle Constitution hongroise, les trois questions juridiques apparues lors de la rédaction de la nouvelle Constitution hongroise, la loi CLXII de 2011 sur le statut juridique et la rémunération des juges en Hongrie et la loi CLXI de 2011 sur l'organisation et l'administration des tribunaux de Hongrie, la loi CLI de 2011 sur la Cour constitutionnelle de Hongrie, les lois cardinales relatives au pouvoir judiciaire qui ont été modifiées par suite de l'adoption de l'avis CDL-AD(2012)001 concernant la Hongrie et la loi sur le droit à la liberté de conscience et de religion et le statut juridique des Églises, des confessions et des communautés religieuses de Hongrie,
– having regard to Opinions Nos CDL(2011)016, CDL(2011)001, CDL-AD(2012)001, CDL-AD(2012)009, CDL-AD(2012)020 and CDL-AD(2012)004 of the European Commission for Democracy through Law (Venice Commission) on the new Constitution of Hungary, on the three legal questions arising from the process of drafting the new Constitution of Hungary, on Act CLXII of 2011 on the legal status and remuneration of judges of Hungary and Act CLXI of 2011 on the organisation and administration of courts of Hungary, on Act CLI of 2011 on the Constitutional Court of Hungary, on the cardinal acts on the judiciary that were amended following the adoption of opinion CDL-AD(2012)001 on Hungary, and on the Act on the right to freedom of conscience and religion and the legal status of churches, denominations and religious communities of Hungary,

1. In principle, all key policy documents, thematic guidelines, legislative opinions, formal comments, pleading notes of Court hearings and prior check opinions shall be made public on the EDPS website.

Calls for the enforcement of intellectual property rights in the online world; notes that Directive 2004/48/EC of the European Parliament and of the Council of 29 April 2004 on the enforcement of intellectual property rights and Directive 2000/31/EC of the European Parliament and of the Council of 8 June 2000 on certain legal aspects of information society services, in particular electronic commerce, in the Internal Market ('Directive on electronic commerce') provide for the effective protection of copyright; believes that within this framework, internet service providers and content providers should cooperate; notes furthermore that the fight against online piracy is a prerequisite to offering and distributing valuable content via the internet; believes, however, that any approach needs to take into account the checks and balances associated with law enforcement and the central role of courts dealing with infringements, as well as data protection rules;

La semaine dernière, la Cour suprême des États-Unis a estimé que les tribunaux militaires spéciaux mis en place par le président Bush en novembre 2001 contre l’avis du Congrès étaient illégaux et contraires aux Conventions de Genève et au système américain de tribunaux militaires.
Last week the Supreme Court in the USA pronounced the special military tribunals appointed by President Bush in November 2001 by way of a decree, bypassing Congress, as illegal and contrary to the Geneva Conventions and the American system of military courts.

La Commission admet qu'un recours devant les tribunaux est souhaitable dans certains cas, mais elle n'est pas convaincue que cela constitue toujours la meilleure solution. Les procédures administratives qui permettent le réexamen des décisions sans formalités excessives peuvent être plus rapides et moins coûteuses que les procédures judiciaires, et la Commission est d'avis qu'elles devraient être possibles dans tous les cas.
Administrative procedures which enable decisions to be reconsidered without excessive formality are likely to be quicker and less costly than judicial procedures and the Commission considers that these should be available in all cases.
