Just as is the case with summary conviction appeals, the review will be conducted by a single judge of the Court of Appeal, and an appeal from the review decision will lie with a three-person panel of the Court of Appeal.

C. whereas the controversial trial failed to meet national and international standards of justice, notwithstanding the call of the United Nations for fairness and transparency in the legal proceedings against former president Nasheed: he was manhandled outside the courtroom and was frequently denied legal representation, the court refused to hear evidence from his own defence witnesses, his legal team was denied adequate time to build a defence against the charges, and the criminal court refuses to release the case report to his defence team, necessary for them to lodge the appeal;

11. se félicite de la coopération de la Serbie avec le TPIY, grâce à laquelle toutes les personnes soupçonnées de crimes de guerre ont été remises au Tribunal de La Haye pour y être traduites en justice; encourage la poursuite de la coopération avec le Tribunal; se joint aux appels répétés du procureur général du TPIY pour que des enquêtes minutieuses soient menées et que des poursuites soient engagées contre les personnes ayant participé aux réseaux de soutien qui ont permis aux fugitifs de demeurer si longtemps en liberté, en particulier dans les services de sécurité militaires ou civils; relève que les poursuites en matière de crimes de guerre nationaux ont avancé de manière constante, mais attire l'attention sur la nécessité de redoubler d'efforts dans les affaires concernant les personnes disparues; demande en outre aux autorités de veiller à la crédibilité et au professionnalisme du programme de protection des témoins et d'y allouer des ressources suffisantes afin que la justice puisse continuer à faire son œuvre en matière de crimes de guerre; attire l'attention sur le fait qu'un certain nombre d'anciens officiers de police ont volontairement choisi de ne pas bénéficier du programme de protection des témoins en raison des nombreux défauts qu'il présente;

Welcomes Serbia’s cooperation with the ICTY, which has resulted in all war crimes suspects being handed over to the Hague Tribunal for trial; encourages further cooperation with the Tribunal; endorses the repeated calls by the ICTY chief prosecutor for the thorough investigation and prosecution of the persons engaged in the support networks which enabled fugitives to remain at large for so long, particularly in the military and civilian security services; notes that domestic war crimes prosecutions have proceeded steadily, but draws attention to the need to deal more vigorously with the issue of missing persons; furthermore calls on the authorities to ensure the credibility and professionalism of the Witness Protection Programme (WPP) and to provide it with adequate resources so that the judiciary can effectively continue its proceedings on war crimes; draws attention to the fact that a number of former police officers voluntarily opted out of the WPP because of its considerable shortcomings;

F. considérant que, à la suite des protestations, le gouvernement a modifié la loi sur le tribunal pour les crimes internationaux de 1973, afin d'introduire une disposition permettant aux demandeurs d'interjeter appel d'un verdict rendu par le tribunal; considérant que la décision du tribunal contre Abdul Qader Mollah peut de ce fait être annulée et remplacée par une condamnation à mort; considérant que cette forme de législation à effet rétroactif viole les normes en matière de procès équitables, compromet la légitimité du travail du tribunal et bafoue le principe "non bis in idem" du droit international, qui est également consacré à l'article 14, paragraphe 7, du pacte international relatif aux droits civils et politiques, auquel le Bangladesh est partie;
F. whereas in the wake of the protests, the government amended the ICT Act of 1973 to introduce a provision allowing plaintiffs to appeal against a verdict delivered by the Tribunal; whereas the court ruling against Abdul Qader Mollah can thus be overturned in favour of a death sentence; whereas this form of retroactive legislation violates fair trial standards, undermines the legitimacy of the ICT’s work and violates the prohibition on double jeopardy (‘ne bis in idem’) in international law, which is also laid down in Article 14(7) of the International Covenant on Civil and Political Rights, to which Bangladesh is a party;

Underscores the need to strengthen the international criminal justice system in general and in this respect notes with concern that Ratko Mladić and Goran Hadžić remain at large and have not been brought before the ICTY; in this context, calls on the Serbian authorities to ensure full cooperation with the ICTY, which should lead to the arrest and transfer of all remaining indictees, in order to open the way to the ratification of a Stabilisation and Association Agreement; notes the need for ongoing support, including financial support, to enable the Special Court for Sierra Leone to complete ongoing trials, including any appeal processes; also notes progress in multilateral cooperation on the supply of expertise and assistance where the identification, collection and preservation of information would assist a wide range of international and transitional justice options, in particular through the Justice Rapid Response (JRR), in which more than half of EU Member States are participants, and encourages ongoing and increased support for the JRR;
