Si l'entreprise, l'établissement ou la partie d'entreprise ou d'établissement conserve son autonomie, le statut et la fonction des représentants ou de la représentation des travailleurs concernés par le transfert subsistent, selon les mêmes modalités et suivant les mêmes conditions qu'avant la date du transfert en vertu d'une disposition législative, réglementaire, administrative ou d'un accord, sous réserve que les conditions nécessaires pour la formation de la représentation des travailleurs soient réunies.
1. Les arguments que mon collègue nous a présentés à l'effet que les travailleurs des usines étaient convaincus que les systèmes antipollution étaient très largement détériorés par la présence du manganèse dans l'essence, je peux comprendre que les travailleurs prétendent cela, mais je peux également regarder en parallèle les différents jugements qui ont été rendus, notamment par les tribunaux américains, à l'effet qu'effectivement, cela ne joue pas sur la détérioration des systèmes antipollution.
The arguments made by my colleague to the effect that plant workers are convinced that the anti-pollution systems are greatly affected by manganese in fuel, are something that I can understand, coming from these workers, but we must also look at rulings, especially by U.S. courts, to the effect that this has nothing to do with deterioration of anti-pollution systems.
