Les dispositions relatives aux transactions d’initiés de la LSA stipulent qu’une action tendant à faire valoir un droit lorsqu’un initié se sert, pour son propre compte, de renseignements confidentiels dont on peut raisonnablement s’attendre à ce qu’ils nuisent de façon appréciable à la valeur de la garantie, se prescrit par deux ans à compter, soit de la découverte des faits qui donnent lieu à l’action, soit du dépôt du rapport (par. 131(5)).
The insider trading provisions of the CBCA state that an action to enforce a right, where an insider makes use of confidential information for his or her own benefit that might reasonably be expected to affect materially the value of the security, must be commenced within two years after the discovery of the facts that gave rise to the action or if the transaction is one that is required to be reported, within two years from the time of reporting (section 131(5)).
