The three Institutions reiterate the role and responsibility of national Parliaments as laid down in the Treaties, in Protocol No 1 on the role of National Parliaments in the European Union annexed to the Treaty on European Union, to the Treaty on the Functioning of the European Union and to the Treaty establishing the European Atomic Energy Community and in Protocol No 2 on the application of the principles of subsidiarity and proportionality, annexed to the Treaty on European Union and to the Treaty on the Functioning of the European Union.

Believes that the Community method should be used for all measures aimed at strengthening the EMU; recalls Article 16 of the TSCG, which states that, within five years, at most, of the date of entry into force of that Treaty, on the basis of an assessment of the experience with its implementation, the necessary steps must be taken, in accordance with the Treaty on the European Union and the Treaty on the Functioning of the European Union, with the aim of incorporating the substance of the Treaty into the legal framework of the European Union;

As a transitional measure, and with respect to acts of the Union in the field of police cooperation and judicial cooperation in criminal matters which have been adopted before the entry into force of the Treaty of Lisbon, the powers of the institutions shall be the following at the date of entry into force of that Treaty: the powers of the Commission under Article 258 of the Treaty on the Functioning of the European Union shall not be applicable and the powers of the Court of Justice of the European Union under Title VI of the Treaty on European Union, in the version in force before the entry into force of the Treaty of Lisbon, shall remain the same, including where they have been accepted under Article 35(2) of the said Treaty on European Union.

First of all, it must be based on a critical analysis, in order to reveal the true challenges facing an enlarged and competent Union, which include the redistribution of competences in both directions – in other words, towards the European Union as well as towards the Member States – a solution to the proliferation of instruments in the European Union, institutions that are more democratic and which ensure, amongst others, a full co-decision procedure involving the European Parliament, the first steps of a process that leads to the treaties being divided into one fundamental treaty and several executing treaties and, lastly, a new position and a new role for the European Union on the world stage.

Je pense que maintenant, dans cette politique de progression, il serait particulièrement important de mentionner la Charte dans l'article 6, paragraphe 2, du traité sur l'Union européenne, parce que cela n'a aucun sens - et je ne veux pas tomber dans la schizophrénie - que l'Union européenne refuse d'accorder une base juridique dans le traité de manière à permettre à l'Union européenne d'adhérer à la convention européenne des droits de l'homme et, en même temps, parle dans le même paragraphe de l'interprétation des droits fondamentaux reposant sur cette convention européenne de sauvegarde des droits de l'homme.
I believe that now, in this policy of forward movement, the inclusion in Article 6(2) of the Treaty on European Union is very important, as there is no sense – and I do not wish to be inconsistent – in the European Union deciding not to provide a legal basis in the Treaty for the Union to be able to adhere to the European Convention on Human Rights and, at the same time, talking in the same paragraph about the interpretation of fundamental rights based on this same European Convention for the Protection of Human Rights.
