Building on the Action Plan approved by the European Council at Amsterdam in 1997(1), the Action Plan of the Council and the Commission on how best to implement the provisions of the Treaty of Amsterdam on an area of freedom, security and justice, approved by the European Council at Vienna in 1998(2), and the conclusions of the European Council in Tampere held on 15 and 16 October 1999, the attached strategy sets out the framework for the work of the Council, the Commission, Europol, the European Judicial Network and the Member States in responding to this challenge.

Il convient cependant de noter que, dans la mesure où elles ne contredisent pas l'acte législatif concerné et où elles sont rendues publiques (ainsi qu'il est prévu par l'article 151, paragraphe 3, du traité CE tel qu'il sera modifié par le traité d'Amsterdam), de telles déclarations interprétatives adoptées par le législateur communautaire sont compatibles avec le droit communautaire.
It should however be noted that insofar as they do not contradict the legislative act concerned and they are made public (as provided for in Article 151(3) of the EC Treaty as it will be amended by the Amsterdam Treaty), such interpretative statements adopted by the Community legislator are compatible with Community law.
