2. The provisions of paragraph 1 shall apply to the Member States which have signed accession protocols to the Schengen agreements, from the dates decided by the Council, acting with the unanimity of its Members mentioned in Article 1, unless the conditions for the accession of any of those States to the Schengen acquis are met before the date of the entry into force of the Treaty of Amsterdam.

Welcomes the fact that, to date, six regulations have been adopted since the entry into force of the Treaty of Amsterdam in the field of judicial cooperation in civil and commercial matters linked to issues having cross-border implications in accordance with Article 65 of the EC Treaty, specifically: on insolvency proceedings; on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters (former 'Brussels I'); on matrimonial matters and parental responsibility for children (former 'Brussels II'); on cooperation between Member State courts in the taking of evidence in civil and commercial matters; on the service in the Member States of judicial and extrajudicial documents in civil or commercial matters; and on parental responsibility and matrimonial matters;

A. whereas, since ratification of the Amsterdam Treaty and the entry into force of Article 255 of the Treaty establishing the European Community, transparency has become a fundamental principle of the European Union the aims of which are to strengthen the democratic nature of the European institutions, enable citizens to participate more closely in the decision-making process, ensure that public administrative authorities enjoy greater legitimacy as a result of being more effective and more accountable to citizens and, finally, enable problems or errors to be detected in a more timely manner,

47. se félicite que les nouvelles dispositions du traité d'Amsterdam aient été traduites dans la nomenclature budgétaire par l'introduction du nouveau titre sous lequel se trouvent regroupées toutes les actions relevant de la création d'un espace de liberté, de sécurité et de justice ; répond aux événements survenus récemment en matière d'afflux de réfugiés, par une dotation renforcée dans ce domaine;

Welcomes the fact that the new provisions of the Treaty of Amsterdam have been acknowledged in the budget nomenclature, in terms of the activities stemming from them, by means of a new title combining all measures concerned with the creation of an area of freedom, security and justice; has stepped up funding in this area by way of its response to recent events with regard to the influx of refugees;

The Commissioner also underlined that this was by far the most politically sensitive and technically difficult issue that the social partners have tackled in formal negotiations at European level as yet and that the successful outcome of the negotiations shows that they are ready to shoulder their new responsibilities under the Amsterdam Treaty.
