La Commission a aussi noté que les règles de procédure désormais applicables aux secteurs anciennement couverts par le traité CECA, c'est-à-dire l'article 88, paragraphe 2, du traité CE, telles que développées dans le règlement (CE) n° 659/1999 du Conseil, du 22 mars 1999, portant modalités d'application de l'article 93 du traité CE(9), offraient de meilleures garanties que celles du traité CECA pour le plein respect des droits de l'État membre, de l'entreprise bénéficiaire et de toutes les autres parties intéressées.
The Commission also indicated that the procedural rules currently applicable to the sectors previously governed by the ECSC Treaty, i.e. Article 88(2) of the EC Treaty, as set out in Council Regulation (EC) No 659/1999 of 22 March 1999 laying down detailed rules for the application of Article 93 of the EC Treaty(9), offer better guarantees than those of the ECSC Treaty for full respect of the rights of the Member State, the beneficiary company and all other interested parties.

(58) Contrary to what the company suggests in its representations, the "Nice Protocol on the financial consequences of the expiry of the ECSC Treaty and on the research fund for coal and steel" does not resolve the issue of the legal framework after the expiry of the ECSC Treaty in a general way, but rather, provides clarification of a very specific issue (the future use of certain ECSC funds), which bears no relationship to the issues with which the present Decision deals.

Any undertaking, research institute or natural person established in the territory of a Member State of the ECSC at the date of the expiry of this Treaty and of a new Member State of the EC under the conditions set out in Article 7 of Council Decision [.../...] laying down the provisions required for implementing the Protocol annexed to the Treaty of Nice on the financial consequences of the expiry of the ECSC Treaty and on the Research Fund for Coal and Steel, can participate in the programme and apply for a financial contribution, provided that it intends carrying out an RTD activity or can substantially contribute to it.

7. rappelle à cet égard que la Cour, dans son ordonnance du 3 mai 1996, a reconnu que le secteur sidérurgique est particulièrement sensible aux perturbations de son fonctionnement concurrentiel, le régime des aides à ce secteur ayant pour objet de garantir la survie des entreprises performantes; ce régime d'aides strictes est précisément concrétisé dans le code des aides à la sidérurgie actuellement en vigueur et qui devrait perdurer au-delà de la fin du traité CECA ;
7. Recalls in this context that in its order of 3 May 1996 the Court accepted that the iron and steel industry is particularly sensitive to disturbances to its competitive operation, the purpose of the system of aids to this industry being to ensure the survival of successful companies; points out that this rigid aid system is accurately defined in the current Steel Aid Code and should continue after the ECSC Treaty expires;
