2. The ECA’s supervision of Investment Facility operations shall be carried out in accordance with the procedures agreed upon between the Commission, the EIB and the ECA, and in particular the Tripartite Agreement between the European Commission, the European Court of Auditors and the European Investment Bank of 27 October 2003, as amended, supplemented or modified from time to time.

In the entries in Annex XVII to Regulation (EC) 1907/2006 for the substances diphenylether, pentabromo derivatives and diphenylether, octabromo derivatives, it should be provided that the restrictions do not apply to articles already in use at the date from which the restriction was to apply as those substances were incorporated in articles which have a long lifecycle and are sold on the second hand market, such as aeroplanes and vehicles.

Quand bien même l’intérêt de l’élaboration d’orientations et éclaircissements supplémentaires devait être confirmé pour contribuer à une utilisation plus fréquente du mécanisme de coordination fondé sur l’article 9, il semble peu probable que de tels éléments puissent totalement résoudre tous les problèmes recensés, notamment lorsqu’il s’agit de lutter de manière plus efficace contre les infractions généralisées présentant un intérêt à l’échelle de l’Union.
Although additional guidance and clarification could be explored as a way to contribute to a more frequent use of the Article 9 coordination mechanism, it appears unlikely to fully resolve all the problems identified, particularly when it comes to addressing widespread EU-level relevant infringements in a most efficient manner.
