IN-CONTEXT TRANSLATIONS

L'article 31, paragraphe 5, de la directive 2012/34/UE confère à la Commission le pouvoir d'adopter des mesures d'exécution déterminant les modalités à suivre pour l'application des redevances correspondant au coût des effets du bruit, y compris en ce qui concerne leur durée d'application, et permettant que les redevances d'infrastructure soient différenciées pour tenir compte, le cas échéant, de la sensibilité de la zone touchée, eu égard notamment à la taille de la population concernée et à la composition des trains ayant une incidence sur le niveau des émissions sonores (les «redevances d'utilisation des voies modulées en fonction du bruit»).
Article 31(5) of Directive 2012/34/EU empowered the Commission to adopt implementing measures setting out the modalities to be followed for the application of the charging for the cost of noise effects including its duration of application and enabling the differentiation of infrastructure charges to take into account, where appropriate, the sensitivity of the area affected, in particular in terms of the size of population affected and the train composition with an impact on the level of noise emissions (‘noise-differentiated track access charges’ or ‘NDTAC’).

1. This Regulation sets out the modalities to be followed by the infrastructure manager for the application of the charging for the cost of noise effects caused by the freight rolling stock.

Notes that, since the expiry of the deadline for implementation of the Directive in 2007, there have been numerous cases of Member States not correctly implementing or applying key provisions, in particular the black list of banned, misleading and aggressive commercial practice; calls therefore on the Commission to continue monitoring closely application of the Directive and, if necessary, to bring proceedings against Member States which infringe the Directive or fail to implement it or to apply it correctly, in accordance with the Treaty on the Functioning of the European Union; calls in particular on the Commission to urgently resolve any outstanding issues with regard to the consultations launched in 2011, either by terminating the infringement procedures or by referring them to the Court of Justice;

Concernant la nécessité de renforcer l'application de la directive, des lacunes existent encore, et la Commission doit suivre attentivement l'application du texte sans hésiter à poursuivre en justice les États membres qui enfreignent, ne mettent pas en œuvre ou ne font pas appliquer correctement la directive, conformément au traité sur le fonctionnement de l'Union européenne.
As regards the need for application of the Directive to be strengthened, shortcomings still exist. The Commission must monitor closely the application of the Directive and not hesitate to bring proceedings against Member States which infringe the Directive or fail to implement it or to apply it correctly, in accordance with the Treaty on the Functioning of the European Union.

(22 bis) Aux fins de l'application du présent règlement, à savoir lorsque celui-ci renvoie à la nationalité comme critère pour l'application de la loi d'un État, la question de la marche à suivre en cas de plurinationalité et celle de savoir si une personne est considérée comme citoyenne d'un État dépendent du droit national ou encore, le cas échéant, d'un accord international, les principes généraux de l'Union européenne devant être respectés sans restriction.
(22a) For the purposes of the application of this Regulation, i.e. where it refers to nationality as a criterion for the application of the law of a State, the question of how to deal with cases of plural nationality and whether a person is to be regarded as a national of a State should be left to national law, or where appropriate also to international agreements, in full observance of the general principles of the European Union.
