Is deeply concerned that the Joint Undertaking has not yet adopted all the rules implementing the Staff Regulations; notes with concern that the working space currently made available is insufficient and impedes its staff from operating in reasonable conditions; is deeply concerned that the working space conditions are having a negative impact on the Joint Undertaking’s efforts to fill all the available posts and reduce the vacancy rate; observes with concern that the working space conditions were cited by its employees as one of the major difficulties and concerns in a recent survey amongst the Joint Undertaking’s staff; asks the Commission and the Director of the Joint Undertaking to present a report to the discharge authority detailing the reasons of the delay on the implementation of the staff regulations and on the situation concerning the working conditions;

The Staff Regulations of Officials and the Conditions of Employment of other Servants of the European Union as laid down by Council Regulation (EEC, Euratom, ECSC) No 259/68 (10) and the rules adopted by agreement between the institutions of the Union for the purpose of giving effect to those Staff Regulations and Conditions of Employment of Other Servants shall apply to the staff employed by the S2R Joint Undertaking.

Le statut des fonctionnaires des Communautés européennes, le régime applicable aux autres agents des Communautés européennes et les réglementations adoptées d'un commun accord par les institutions des Communautés européennes aux fins de l'application de ce statut et de ce régime sont applicables au personnel de l'entreprise commune ENIAC et à son directeur exécutif.

The Staff Regulations of Officials of the European Communities, the Conditions of Employment of Other Servants of the European Communities and the rules adopted jointly by the institutions of the European Communities for the purpose of applying these Staff Regulations and Conditions of Employment shall apply to the staff of the ENIAC Joint Undertaking and its executive director.

2. Sans préjudice du paragraphe 3 du présent article et de l'article 7, paragraphe 2, des statuts, l'entreprise commune ENIAC exerce à l'égard de son personnel les pouvoirs qui sont dévolus à l'autorité investie du pouvoir de nomination par le statut des fonctionnaires des Communautés européennes et à l'autorité habilitée à conclure les contrats d'engagement par le régime applicable aux autres agents des Communautés européennes.

Without prejudice to paragraph 3 of this Article and Article 7(2) of the statutes, the ENIAC Joint Undertaking shall exercise the powers conferred on the appointing authority by the Staff Regulations of Officials of the European Communities and on the authority empowered to conclude contracts by the Conditions of Employment of Other Servants of the European Communities in respect of its staff.

Les modalités de l'organisation et du fonctionnement de l'entreprise commune ENIAC devraient être fixées dans les statuts de l'entreprise commune ENIAC, qui font partie intégrante du présent règlement.
The rules for the organisation and operation of the ENIAC Joint Undertaking should be laid down in the statutes of the ENIAC Joint Undertaking as part of this Regulation.
