Welcomes the fact that after the former Head of the Legal Service left the Agency in June 2012 to join a US-based law firm having a number of pharmaceutical industry companies as clients as senior counsel, the Executive Director of the Agency launched a review of his work as Head of the Legal Service, Chair of the Joint Committee, Chair of the Disciplinary Committee and as a member of the Advisory Committee on Procurement and Contracts; acknowledges that no evidence of conflicts of interest nor breach of obligations provided in Articles 11 and 11a of the Staff Regulations could be identified; welcomes the fact that in accordance with Article 16 of the Staff Regulations, the Executive Director imposed some restrictions to the activities of the former Head of Legal Service for a period of two years following his leaving the Agency; calls on the Agency to provide the discharge authority with detailed information on those restrictions;

A. considérant que l’Union européenne a conclu un accord avec le Canada en 2005 sur le traitement des données des dossiers passagers (PNR) sur la base d’une série d’engagements pris par l'Agence des services frontaliers du Canada (ASFC) en ce qui concerne l’application de son programme PNR; considérant que, à l’expiration de la décision concernée de la Commission le 22 septembre 2009, la base juridique européenne pour la transmission de données PNR à l’ASFC a cessé d’exister;
A. whereas the European Union concluded an agreement with Canada in 2005 on the processing of Passenger Name Record (PNR) data on the basis of a set of commitments by the Canada Border Services Agency (CBSA) in relation to the application of its PNR programme; whereas with the expiry of the relevant Commission decision on 22 September 2009, the European legal basis for the transmission of PNR data to the CBSA ceased to exist;

Thanks to the elimination of Korean import duties of around EUR 1.6 billion and EU import duties of around EUR 1.1 billion, there will be a significant liberalisation of trade in important sectors of industry and in services. This concerns mainly telecommunications, environment protection, transport, finance and legal services.

2. appelle de ses vœux un accord avec le Canada qui aille au-delà des engagements pris dans le cadre de l'OMC et qui soit complémentaire des règles multilatérales, à condition que les négociations aboutissent à un accord équilibré, ambitieux et de qualité qui aille bien au-delà de réductions tarifaires; demande l'application du principe de réciprocité dans le cadre des recours juridiques disponibles en cas de litiges commerciaux et souligne en particulier la nécessité d'améliorer la protection des droits de propriété intellectuelle, y compris des marques commerciales, brevets et indications géographiques, et d'obtenir un accès véritablement réciproque au marché, notamment aux services et aux marchés publics (y compris au niveau subfédéral);
2. Welcomes an agreement with Canada going beyond the WTO commitments and being complementary to multilateral rules, provided that the negotiations produce a balanced, ambitious, high-quality agreement that goes well beyond tariff reductions; calls for the reciprocity principle to be applied in the context of the legal remedies available in the event of commercial disputes and emphasises in particular the need to improve the protection of intellectual property rights including trademarks, patents and geographical indications and to obtain genuinely reciprocal access to the market, especially to services and public procurement markets (including at sub-federal level);
