RECOGNISES that Article 3(9) of the Kyoto Protocol provides that the first Conference of the Parties serving as the Meeting of the Parties to the Protocol shall initiate the consideration of further commitments to be undertaken by developed countries at least seven years before the end of the first commitment period; and STRESSES that the COP/MOP should therefore initiate such considerations at its first meeting in December 2005 in Montreal; RECALLS also that Article 9 provides for a first review of the Kyoto Protocol at the second session of the Conference of the Parties serving as the meeting of the Parties to the Protocol, and that this review is to be coordinated with pertinent reviews under the United Nations Framework Convention on Climate Change. 4. Le cas échéant, la Commission, agissant conformément à la procédure visée à l'article 13, paragraphe 2, modifie les orientations sur la gestion et l'attribution de la capacité de transfert disponible des interconnexions entre les réseaux nationaux fixées à l'annexe, conformément aux principes établis aux articles 5 et 6, notamment pour ajouter des orientations détaillées sur toutes les méthodes d'attribution de capacités appliquées dans la pratique et pour veiller à ce que les mécanismes de gestion des congestions évoluent d'une manière compatible avec les objectifs du marché intérieur.
4. Where appropriate, the Commission shall, acting in accordance with the procedure referred to in Article 13(2), amend the guidelines on the management and allocation of available transfer capacity of interconnections between national systems set out in the Annex, in accordance with the principles set out in Articles 5 and 6, in particular so as to include detailed guidelines on all capacity allocation methodologies applied in practice and to ensure that congestion management mechanisms evolve in a manner compatible with the objectives of the internal market.

9. The Council also invites the Commission: (a) to continue, together with the other providers of funds, its discussions on improving the effectiveness and conditionality of reform programmes put into effect under the auspices of the Bretton Woods institutions, so that it will be possible, whilst complying with the requirements of financial stabilization and the principle of payment in instalments: - to emphasize measurable medium- and long-term objectives, and the economic and institutional results obtained by implementing the approved programmes; - to give better support to countries showing genuine commitment to reform; - to ensure increased participation by national partners in beneficiary countries in the definition and content of the programmes, including, if necessary, by supporting the strengthening of national capabilities; - to concentrate efforts on a significant set of basic reforms; (b) with regard to the ACP States, to give technical assistance to the countries concerned which have integration projects so that they can move towards greater exchange rate stability and more convertibility, and to foster coordination in the area of macro-economic reforms implemented by eligible countries; (c) with regard to the South and East Mediterranean countries, to situate adjustment support programmes in the context of the creation of a free trade area with the European Union (d) with regard to the countries of Latin America and Asia, the Community could continue to undertake development activities aimed at mitigating the social costs of structural adjustment, whilst complying with the regulations applicable.

6. S'agissant des critères d'éligibilité pour l'aide à la réhabilitation, le Conseil, tout en faisant preuve de toute la souplesse nécessaire, partage l'avis de la Commission selon lequel il y a lieu, entre autres, de prendre en considération les éléments suivants : - demande formulée par les partenaires, notamment ceux qui agissent au niveau national et local, dans le pays concerné ; - situation de sinistre grave qui empêche la couverture des besoins essentiels des populations ; - existence d'un niveau minimal de sécurité ; - engagement effectif dans un processus de transition respectueux des valeurs démocratiques et des libertés fondamentales ; - capacité de mise en oeuvre des actions de réhabilitation par les Administrations et/ou d'autres partenaires concernés.
6. Regarding the criteria of eligibility for rehabilitation aid, the Council will display all the necessary flexibility but shares the Commission's view that account should be taken of the following aspects in particular: - request made by the partners, and in particular those operating at national and local level in the country concerned; - serious disaster situation which prevents the essential needs of the population being met; - existence of a minimum level of security; - actual commencement of a transition process which respects democratic values and fundamental freedoms; - ability of the Authorities and/or other partners involved to implement rehabilitation measures.
