c) Les infractions consistant dans la non-transposition ou la non-conformité de la transposition des directives car elles peuvent priver, de fait, un grand nombre de citoyens de l'accès au droit communautaire et constituent une source potentielle de nombreux manquements.Les critères ci-dessus aideront la Commission à optimiser le recours aux divers instruments propres à obtenir le rétablissement aussi rapide que possible d'une situation conforme aux Traités. L'enjeu du contrôle de l'application du droit et de la poursuite des infractions assumés par la Commission n'est pas en effet de « sanctionner » un Etat membre, mais de rétablir l'application correcte du droit communautaire.
The above criteria will help the Commission to make the best use of the various mechanisms designed to restore a situation in line with the Treaties as rapidly as possible, bearing in mind that the Commission's purpose in monitoring the application of Community law and bringing proceedings against infringements is not to "punish" a Member State, but to ensure that Community law is applied correctly.

In order to supplement and amend certain non-essential elements of this Regulation, the power to adopt acts in accordance with Article 290 TFEU should be delegated to the Commission in respect of the identification of the period of time and of the relevant starting or ending dates of the period of time with regard to the admissibility criteria of applications, adjusting the percentages concerning the indicative distribution of funds among the objectives under direct management, the definition of eligible operations and costs for hygiene, health and safety-related investments and investments concerning working conditions, on board or in individual equipment, the definition of eligible costs of operations to protect and restore marine biodiversity and ecosystems in the framework of sustainable fishing activities, the definition of costs eligible for support with regard to investments in equipment or on board aimed at reducing the emission of pollutants or green-house gases and increasing the energy efficiency of fishing vessels, the definition of the criteria for calculation of the additional costs resulting from the specific handicaps of outermost regions, the definition of the cases of non-compliance by Member States which can trigger interruption of the payment deadline or suspension of payments, the definition of the criteria for establishing the level of financial correction to be applied and the criteria for applying flat rates or extrapolated financial corrections and the definition of the content and construction of the common monitoring and evaluation system.

L'objectif des corrections financières est de rétablir une situation où 100 % des dépenses faisant l'objet d'une demande de cofinancement du Fonds soient en conformité avec la réglementation nationale et communautaire applicable en la matière.
The purpose of financial corrections is to restore a situation where 100 % of the expenditure declared for co-financing from the Fund is in line with the applicable national and Community rules and regulations.

Si, lors de l'application des règles énoncées à l'annexe II, les exportations des États ACP sont affectées, la Communauté examinera et, le cas échéant, adoptera des mesures correctives appropriées visant à remédier à la situation en vue de rétablir la situation ex-ante (décision n° 2/97 du Conseil des ministres).
If in the application of the rules contained in Annex II, ACP States' exports are adversely affected, the Community will examine and, where necessary, adopt appropriate corrective measures to remedy the situation with a view to re-establishing the ex-ante situation (Decision 2/97 of the Council of Ministers).

Si, malgré les mesures prises pour satisfaire aux obligations imposées par l'article 4, paragraphe 1, les eaux destinées à la consommation humaine ne satisfont pas aux valeurs paramétriques fixées, conformément à l'article 5, et sous réserve de l'article 6, paragraphe 2, l'État membre concerné veille à ce que les mesures correctives nécessaires soient prises le plus rapidement possible afin de rétablir la qualité et accorde la priorité à leur application, compte tenu, entre autres, de la mesure dans laquelle la valeur paramétrique pertinente a été dépassée et du danger potentiel pour la santé des personnes.
2. If, despite the measures taken to meet the obligations imposed in Article 4(1), water intended for human consumption does not meet the parametric values set in accordance with Article 5, and subject to Article 6(2), the Member State concerned shall ensure that the necessary remedial action is taken as soon as possible to restore its quality and shall give priority to their enforcement action, having regard inter alia to the extent to which the relevant parametric value has been exceeded and to the potential danger to human health.
