E. considérant qu'aux termes de l'article 11, paragraphe 1, du règlement relatif au Fonds, un maximum de 0,5 % du montant annuel du Fonds peut être affecté chaque année à l'assistance technique, sur l'initiative de la Commission, pour financer les activités de préparation, de surveillance, de collecte de données et de création d'une base de connaissances, le soutien administratif et technique, les activités d'information et de communication ainsi que les activités d'audit, de contrôle et d'évaluation nécessaires à l'application du règlement relatif au Fonds; qu'en vertu de l'article 11, paragraphe 4, du règlement relatif au Fonds, l'assistance technique de la Commission comprend la fourniture d'informations et de conseils aux États membres, pour l'utilisation, le suivi et l'évaluation du Fonds, et aux partenaires sociaux européens et nationaux, pour son utilisation;
E. whereas up to 0,5 % of the annual EGF amount can be made available each year for technical assistance at the initiative of the Commission, in order to finance preparation, monitoring, data gathering and creation of a knowledge base, administrative and technical support, information and communication activities as well as audit, control and evaluation activities necessary to implement the EGF Regulation, as stipulated in Article 11(1) of that Regulation; whereas technical assistance shall also include the provision of information and guidance for the Member States in using, monitoring and evaluating the EGF to the European and national social partners, as stipulated in Article 11(4) of the EGF Regulation;

D. considérant que jusqu'à 0,35 % du montant annuel du Fonds peut être consacré, chaque année, à l'assistance technique sur l'initiative de la Commission, afin de financer les activités de surveillance, d'information, de soutien administratif et technique, d'audit, de contrôle et d'évaluation nécessaires à la mise en œuvre du règlement relatif au Fonds, comme le prévoit l'article 8, paragraphe 1, dudit règlement, y compris la fourniture d'informations et de conseils aux États membres pour l'utilisation, le suivi et l'évaluation du Fonds et la fourniture d'informations sur l'utilisation du Fonds aux partenaires sociaux européens et nationaux (article 8, paragraphe 4, dudit règlement);

1. By way of derogation from Article 3, the competent authority, as listed in Annex II, of the Member State where the exporter or service provider is established, may authorise, under such conditions as it deems appropriate, the sale, supply, transfer or export of non-lethal equipment listed in Annex I, or the provision of technical assistance, financing or financial assistance related to such non-lethal equipment, after having determined that the non-lethal equipment concerned is intended solely to enable the Ivorian security forces to use only appropriate and proportionate force while maintaining public order.

2. Par dérogation à l’article 3, l’autorité compétente, mentionnée à l’annexe II, de l’État membre où l’exportateur ou le prestataire de services est établi peut autoriser, dans les conditions qu’elle juge appropriées, la vente, la fourniture, le transfert ou l’exportation d’équipements susceptibles d’être utilisés à des fins de répression interne énumérés à l’annexe I, destinés exclusivement à appuyer le processus ivoirien de réforme du secteur de la sécurité, ainsi que la fourniture d’un financement, d’une assistance financière ou d’une assistance technique se rapportant à ces équipements.

By way of derogation from Article 3, the competent authority, as listed in Annex II, of the Member State where the exporter or service provider is established, may authorise, under such conditions as it deems appropriate, the sale, supply, transfer or export of equipment which might be used for internal repression as listed in Annex I, which is intended solely for the support of the Ivorian process of Security Sector Reform, as well as the provision of financing, financial assistance or technical assistance related to such equipment.

The competent authority shall consult the authority or authorities which, in the preceding three years, dismissed an application for authorisation of an import or export or the supply of technical assistance under this Regulation, if it receives an application concerning an import or export or the supply of technical assistance involving an essentially identical transaction referred to in such earlier application and considers that an authorisation should, nevertheless, be granted.
