IN-CONTEXT TRANSLATIONS

Afin d'assurer des conditions uniformes d'exécution du présent règlement et d'éviter toute concurrence déloyale ou toute discrimination entre agriculteurs, il convient de conférer des compétences d'exécution à la Commission en ce qui concerne: la fixation du montant à inclure dans la réserve spéciale nationale pour le déminage pour la Croatie; la fixation du plafond national annuel pour le régime de paiement de base; l'adoption de règles relatives aux demandes d'attribution de droits au paiement; l'adoption de mesures relatives au reversement des droits au paiement non utilisés à la réserve nationale; l'adoption de modalités relatives à la notification du transfert des droits au paiement aux autorités nationales et des délais dans lesquels ces notifications doivent être effectuées; la fixation du plafond national annuel pour le régime de paiement unique à la surface; l'adoption de règles relatives aux demandes d'attribution de droits au paiement présentées au cours de l'année d'attribution des droits au paiement lorsque les États membres passent au régime de paiement de base; la fixation de plafonds annuels pour le paiement redistributif.
In order to ensure uniform conditions for the implementation of this Regulation and to avoid unfair competition or discrimination between farmers, implementing powers should be conferred on the Commission in respect of: setting the amount to be included in the special national de-mining reserve for Croatia; fixing the annual national ceiling for the basic payment scheme; adopting rules on applications for allocation of payment entitlements; adopting measures regarding the reversion of non-activated payment entitlements to the national reserve; adopting modalities of the notification of transfer of payment entitlements to the national authorities and the deadlines within which such notifications are to take place; fixing the annual national ceiling for the single area payment scheme; adopting rules on applications for allocation of payment entitlements submitted in the year of allocation of payment entitlements where Member States change to the basic payment scheme; fixing annual ceilings for the redistributive payment.

In order to ensure legal certainty, and in order to clarify the specific situations that may arise in the application of the basic payment scheme, the power to adopt certain acts should be delegated to the Commission in respect of rules on eligibility and access in respect of the basic payment scheme of farmers, in the case of inheritance and anticipated inheritance, inheritance under a lease, change of legal status or denomination, transfer of payment entitlements, and in the case of a merger or scission of the holding and in the case of a contract clause regarding the right to receive payment entitlements in the first year of allocation of payment entitlements.

(2) For the purposes of subsection (1), if, for any attribution point in respect of an investment plan for a particular period in which a fiscal year of the investment plan ends, the total of all amounts — each of which is the total value of the particular units of the investment plan held on the attribution point either by a person that is an individual or a specified investor in the investment plan for the fiscal year and in respect of which the investment plan knows, on December 31 of the calendar year in which the fiscal year ends, whether or not the person is resident in Canada on the attribution point and, in the case of individuals and specified investors resident in Canada, the province in which the person is resident on the attribution point or by a person that is neither an individual nor a specified investor in the investment plan for the fiscal year and in respect of which the investment plan knows, on December 31 of the calendar year, the person’s investor percentage for each participating province as of the attribution point — is less than 50% of the total value of the units of the investment plan on the attribution point, the following rules apply:

(2) For the purposes of subsection (1), if a selected listed financial institution is a pension entity of a particular pension plan or is a private investment plan that is a trust governed by a particular deferred profit sharing plan, a particular employees profit sharing plan or a particular retirement compensation arrangement and if, for any attribution point in respect of the financial institution for a particular period in which a fiscal year of the financial institution ends, the total of all amounts — each of which is the total value, on the attribution point, of the assets of the particular plan or arrangement that are reasonably attributable to a plan member (in this subsection referred to as a “known member”) of the financial institution in respect of which the financial institution knows, on December 31 of the calendar year in which the fiscal year ends, whether or not the plan member is resident in Canada on the attribution point and, in the case of plan members resident in Canada, the province in which the plan member is resident on the attribution point — is less than 50% of the total value, on the attribution point, of the assets of the particular plan or particular arrangement, the following rules apply:

Le règlement (CE) no 1782/2003 du Conseil du 29 septembre 2003 établissant des règles communes pour les régimes de soutien direct dans le cadre de la politique agricole commune et établissant certains régimes de soutien en faveur des agriculteurs a autorisé la Commission à adopter entre autres une disposition applicable aux situations dans lesquelles l’attribution de droits au paiement à un agriculteur entraînerait pour celui-ci des gains exceptionnels.
Council Regulation (EC) No 1782/2003 of 29 September 2003 establishing common rules for direct support schemes under the common agricultural policy and establishing certain support schemes for farmers authorised the Commission to adopt, inter alia, a provision to deal with the situation where the allocation of payment entitlements to a farmer would lead to a windfall profit for the farmer.
