réaffirme l'accord interinstitutionnel «Common Approach to Impact Assessment» (4) mentionné dans la communication de la Commission sur la stratégie pour la mise en œuvre effective de la Charte des droits fondamentaux par l'Union européenne, qui établit que le Parlement et le Conseil sont chargés d'évaluer l'impact de leurs propres amendements;

rappelle que conformément à l'article 53 ter du règlement financier et au point 44 de l'accord interinstitutionnel du 17 mai 2006 dont l'objectif est d'assurer un contrôle interne efficace et intégré des ressources communautaires et des déclarations nationales de gestion, les États membres se sont engagés à élaborer chaque année, au niveau national approprié, un récapitulatif des contrôles des comptes et des déclarations disponibles; constate que, d'après les informations reçues de la Commission, seul un petit nombre d'États membres respectant actuellement les dispositions de l'accord interinstitutionnel; regrette qu'aucune des propositions concrètes relatives aux déclarations nationales présentées par le Parlement européen dans ses résolutions de décharge 2003, 2004 et 2005 n'ait été reprise dans la stratégie d'audit de la Commission, et invite cette dernière à tenir le Parlement au courant; rappelle aux États membres qu'ils sont tenus de respecter les dispositions du règlement financier révisé sur lequel ils ont seulement récemment marqué leur accord; réaffirme en outre que les États membres sont tenus de remplir les conditions énoncées au point 44 de l'accord interinstitutionnel et qu'ils ont l'obligation, en vertu de l'article 274 du traité CE, de coopérer pleinement avec la Commission, conformément aux principes de bonne gestion financière;
Recalls that, in accordance with Article 53b of the Financial Regulation and Point 44 of the IIA of 17 May 2006, which aim at ensuring effective and integrated internal control of Community funds and national management declarations as a final goal, the Member States have committed themselves to "produce an annual summary at the appropriate national level of the available audits and declarations"; notes that, according to information received from the Commission, only a limited number of Member States have complied with the provisions of the IIA so far; regrets that none of the concrete proposals on national (management) declarations put forward by the European Parliament in its 2003, 2004 and 2005 discharge resolutions are incorporated in the Commission's Audit Strategy and requests the Commission to keep the Parliament informed; reminds the Member States of their obligation to comply with the provisions of the revised Financial Regulation, to which they only recently agreed; reiterates that Member States are further obliged to fulfil the conditions set out in Point 44 of the IIA as well as being obliged under Article 274 TEC to cooperate fully with the Commission according to the principles of sound financial management;

RÉAFFIRME son intention d'évaluer l'incidence des modifications de fond qu'il apporte aux propositions législatives, évaluation qu'il appartiendra aux organes préparatoires compétents du Conseil de décider, en vue de l'élaboration de bonnes pratiques, conformément à l'engagement pris dans l'accord interinstitutionnel "Mieux légiférer", sans qu'il soit porté atteinte à la capacité du législateur de proposer des modifications.

REAFFIRMS its intention to carry out impact assessments on substantive Council amendments, to be determined by the appropriate Council preparatory bodies, to legislative proposals, with a view to developing best practice, in line with the commitment in the Inter-institutional Agreement on Better law-making, without prejudice to the legislator’s capacity to propose amendments.

Il a notamment réaffirmé qu'il préférait nettement des modalités d'application reposant sur le cadre Lamfalussy pour tous les secteurs financiers, comme proposé dans le rapport, c'est-à-dire conformes aux accords interinstitutionnels existants, comportant toutes les dispositions en matière de responsabilité devant le Parlement européen et le Conseil déjà adoptées pour les valeurs mobilières y compris la clause de limitation dans le temps avec une révision intégrale et ouverte en 2004 et reconnaissant les spécificités sectorielles.
In particular, it reaffirmed its clear preference for implementing arrangements based upon the Lamfalussy framework to all financial sectors as proposed in the report, i.e. according to existing inter-institutional agreements, incorporating all accountability measures to the European Parliament and the Council already adopted for securities - including the sunset clause with a full and open review in 2004 - and recognising sectoral specificities.
