(10a) With reference to Directive 2006/24/EC of the European Parliament and of the Council of 15 March 2006 on the retention of data generated or processed in connection with the provision of publicly available electronic communications services or of public communications networks 1 , which provides for data stored by private persons to be made available for the investigation, detection and prosecution of serious offences, there should be a minimum degree of harmonisation of the obligations of private individuals persons processing data when carrying out a public service remit; the rules permitting access to such data by the competent authorities of a Member State should also be harmonised.
