Conformément au règlement (CE, Euratom) no 1605/2002 du Conseil du 25 juin 2002 portant règlement financier applicable au budget général des Communautés européennes (1) et au règlement financier adopté par le conseil d'administration de l'Agence le 26 mars 2003, au règlement (CE, Euratom) no 2343/2002 de la Commission du 19 novembre 2002 portant règlement financier-cadre des organismes visés à l'article 185 du règlement (CE, Euratom) no 1605/2002 du Conseil portant règlement financier applicable au budget général des Communautés européennes (2), ainsi qu'aux autres réglementations auxquelles se réfère la présente décision, les contrats ou conventions conclus ainsi que les décisions prises avec des bénéficiaires établis en Suisse peuvent prévoir que des audits scientifiques, financiers, technologiques ou autres peuvent être effectués à tout moment auprès d'eux et de leurs sous-traitants par des agents de l'Agence et de la Commission ou par d'autres personnes mandatées par celles-ci.

In accordance with Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities (1) and the Financial Regulation adopted by the Management Board of the Agency on 26 March 2003, with Commission Regulation (EC, Euratom) No 2343/2002 of 19 November 2002 on the framework Financial Regulation for the bodies referred to in Article 185 of Council Regulation (EC, Euratom) No 1605/2002 on the Financial Regulation applicable to the general budget of the European Communities (2) and with the other instruments referred to in this Decision, contracts or agreements concluded and decisions taken with beneficiaries established in Switzerland may provide for scientific, financial, technological or other audits to be conducted at any time on the premises of the beneficiaries and of their subcontractors by Agency and Commission officials or by other persons mandated by the Agency and the Commission.

Is concerned at the complexity of EU financial regulations and guidelines for European financial instruments, in particular when European funds and programmes are used to support individual enterprises through the provision of relatively small amounts of funding; considers that the expense in terms of time and money involved in complying with these regulations is out of all proportion to the benefits for the final recipient of the funding; calls for streamlined management, administrative and reporting efficiency and cost-effectiveness in connection with innovative financial instruments; insists that banks, intermediaries and beneficiaries must not be discouraged or deterred from using programmes and funds by the administrative burdens involved; asks the Commission to propose simplified and less costly regulations and guidelines, especially for programmes intended to support low-volume SME finance in the form of guarantees and mezzanine or equity instruments;

À la suite de l'adoption du règlement (CE, Euratom) no 1995/2006 du Conseil du 13 décembre 2006 modifiant le règlement (CE, Euratom) no 1605/2002 portant règlement financier applicable au budget général des Communautés européennes (3), il est nécessaire d’adapter le règlement (CE) no 1653/2004 (4) de la Commission afin de l'aligner sur le règlement (CE, Euratom) no 1605/2002 du Conseil du 25 juin 2002 portant règlement financier applicable au budget général des Communautés européennes (ci-après le «règlement financier général») (5).
Following the adoption of Council Regulation (EC, Euratom) No 1995/2006 of 13 December 2006 amending Regulation (EC, Euratom) No 1605/2002 on the Financial Regulation applicable to the general budget of the European Communities (3), it is necessary to adapt Commission Regulation (EC) No 1653/2004 (4) in order to align it with Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities (hereinafter: general Financial Regulation) (5).

The Joint Undertaking should have, subject to prior consultation with the Commission, its own financial regulation based on the principles of Commission Regulation (EC, Euratom) No 2343/2002 of 19 November 2002 on the Framework Financial Regulation for the bodies referred to in Article 185 of Council Regulation (EC, Euratom) No 1605/2002 on the Financial Regulation applicable to the general budget of the European Communities (the Framework Financial Regulation) taking into account its specific operating needs arising, in particular, from its international obligations.
