(39)In order to ensure uniform conditions for the implementation of the provisions of this Regulation in respect of the establishment of the specification of devices to reduce wear and tear, to strengthen or to limit the escape of catches in the forward part of towed gears; to define the specification of the selection devices attached to defined baseline gears; to define the specifications of the pulse trawl; restrictions on construction and the control and monitoring measures to be adopted by the flag Member State; to define rules on: the control and monitoring measures to be adopted by the flag Member State when using static gears in depths between 200-600 metres, to define detailed rules on the control and monitoring measures to be adopted for certain closed or restricted areas; and to define detailed rules on the signal and implementation characteristics of devices used to deter cetaceans from static nets and methods used to minimise bycatches of seabirds and marine reptiles, implementing powers should be conferred on the Commission.

F. considers that the rules on the composition of national teams, or the rules relating to the selection by sports federations of those of their members who may participate in high-level international competitions are purely sporting rules which therefore, by their nature, fall outside the scope of Article 39 and Article 49 of the Treaty. Also among such rules are ‘the rules of the game’ in the strict sense, such as, for example, the rules fixing the length of matches or the number of players on the field, the organisation and conduct of sporting events and championships, given that sport can exist and be practised only in accordance with specific rules. En conclusion, honorables sénateurs, je dirai que les craintes exprimées par le sénateur Taylor au sujet des investissements dans des actions risquées ne constituent pas un argument en faveur du maintien de la règle sur la propriété étrangère, mais plutôt un argument en faveur de l'adoucissement de ces restrictions, voire de leur élimination, pour permettre une plus grande diversification des investissements partout dans le monde.
I close, honourable senators, by saying that Senator Taylor's concerns about investing in risky individual stocks is not a reason to argue for maintaining the foreign property rule, rather an argument for increasing or even eliminating the restriction to permit greater diversification through global investing.
