(1) Conformément à la décision 2011/167/UE du Conseil autorisant une coopération renforcée dans le domaine de la création d’une protection par brevet unitaire, la Belgique, la Bulgarie, la République tchèque, le Danemark, l'Allemagne, l'Estonie, l'Irlande, la Grèce, la France, Chypre, la Lettonie, la Lituanie, le Luxembourg, la Hongrie, Malte, les Pays-Bas, l'Autriche, la Pologne, le Portugal, la Roumanie, la Slovénie, la Slovaquie, la Finlande, la Suède et le Royaume-Uni (ci-après dénommés «États membres participants») ont été autorisés à instaurer entre eux une coopération renforcée dans le domaine de la création d’une protection par brevet unitaire.

The Kingdom of Belgium, the Republic of Bulgaria, the Czech Republic, the Kingdom of Denmark, the Federal Republic of Germany, the Republic of Estonia, Ireland, the Hellenic Republic, the French Republic, the Republic of Cyprus, the Republic of Latvia, the Republic of Lithuania, the Grand Duchy of Luxembourg, the Republic of Hungary, Malta, the Kingdom of the Netherlands, the Republic of Austria, the Republic of Poland, the Portuguese Republic, Romania, the Republic of Slovenia, the Slovak Republic, the Republic of Finland, the Kingdom of Sweden and the United Kingdom of Great Britain and Northern Ireland are hereby authorised to establish enhanced cooperation between themselves in the area of the creation of unitary patent protection, by applying the relevant provisions of the Treaties.

Dans ces circonstances, douze États membres, à savoir le Danemark, l’Allemagne, l’Estonie, la France, la Lituanie, le Luxembourg, les Pays-Bas, la Pologne, la Slovénie, la Finlande, la Suède et le Royaume-Uni ont adressé à la Commission, par lettres des 7, 8 et 13 décembre 2010, des demandes précisant qu’ils souhaitaient instaurer entre eux une coopération renforcée dans le domaine de la création d’une protection par brevet unitaire, sur la base des propositions existantes que ces États membres ont soutenues pendant les négociations, et invitant la Commission à soumettre une proposition en ce sens au Conseil.
In these circumstances, 12 Member States, namely Denmark, Germany, Estonia, France, Lithuania, Luxembourg, the Netherlands, Poland, Slovenia, Finland, Sweden and the United Kingdom, addressed requests to the Commission by letters dated 7, 8 and 13 December 2010 indicating that they wished to establish enhanced cooperation between themselves in the area of the creation of unitary patent protection on the basis of the existing proposals supported by these Member States during the negotiations and that the Commission should submit a proposal to the Council to that end.

(6) La Belgique, la Bulgarie, l'Allemagne, la Grèce, l'Espagne, la France, l'Italie, la Lettonie, le Luxembourg, la Hongrie, Malte, l'Autriche, le Portugal, la Roumanie et la Slovénie ont ultérieurement présenté à la Commission une demande indiquant qu'ils avaient l'intention d'instaurer entre eux une coopération renforcée dans le domaine de la loi applicable en matière matrimoniale.
(6) Belgium, Bulgaria, Germany, Greece, Spain, France, Italy, Latvia, Luxembourg, Hungary, Malta, Austria, Portugal , Romania and Slovenia subsequently addressed a request to the Commission indicating that they intended to establish enhanced cooperation between themselves in the area of applicable law in matrimonial matters.

I. considérant notamment qu'il est possible de voir dans cette coopération renforcée une démarche visant à favoriser la réalisation des objectifs de l'Union, à préserver ses intérêts et à renforcer son processus d'intégration au sens de l'article 20 du traité sur l'Union européenne, et ce sur la base de la large consultation des parties intéressées que la Commission a lancée avec son Livre vert (COM(2005)0082) au titre de son évaluation d'impact, compte tenu du fait que les mariages "internationaux" sont très nombreux et que quelque 140 000 divorces prononcés dans l'Union en 2007 présentaient une dimension internationale, sachant que cette année-là, la majorité de ces nouveaux "divorces internationaux" impliquait deux États souhaitant participer à cette coopération renforcée (la France et l'Allemagne),
I. whereas, in particular, this enhanced cooperation may be regarded as enhancing the Union's objectives, protecting its interests and reinforcing its integration process within the meaning of Article 20 of the Treaty on European Union, in the light of the Commission's extensive consultation of stakeholders as part of its impact assessment in connection with its Green Paper (COM(2005)0082), the large number of "international" marriages and the approximately 140 000 divorces with an international element in the Union in 2007, bearing in mind that two of the countries intending to participate in the enhanced cooperation, Germany and France, had the highest share of new "international" divorces in that year,
